While the definition of 'service mark' in §45 of the Trademark Act, 15 U.S.C. §1127, includes a reference to character names, such names must be used to identify and indicate the source of a service before they are registrable.
Three-dimensional marks are those which, when in use, have depth as well as height and breadth, for example, a three-dimensional display or structure at or near the place, such as a restaurant, where the service is performed.
