New York State reasons from Worcester that, as reservation status and jurisdiction went hand in hand, by obligating the Oneidas to remove from New York, there was an intent to terminate tribal jurisdiction and thereby disestablish the Reservation.
Sherrill's financial condition is not indicative of being on the brink of bankruptcy, and is not supportive of a claim of irreparable harm.

Barbara Harris Sherrill, founder and president of the Seabury House Guild, former national headquarters of the Episcopal Church in the United States, died Tuesday, as the result of a stroke, at Massachusetts General Hospital in Boston.
Sherrill, who was born in Salem, Mass., was president of the Seabury House Guild, which is in Greenwich, Conn., from 1947 to 1958.
She is survived by three sons, the Rev. Franklin Goldthwaite Sherrill of Brooklyn Heights, the Rev. Henry William Sherrill of Lancaster, N.H., and the Right Rev. Edmund Knox Sherrill of Rio de Janiero; a daughter, Barbara Prue Sherrill Wilson of Framingham, Mass.; a sister, Virginia Harris Montgomery of Portland, Me.; 12 grandchildren, and 13 great-grandchildren.

Sherrill's Amended Complaint does not allege that the Nation representatives are owners of the properties, reside in Sherrill, or have their names on the tax roll.

Sherrill first argues that the Oneidas' right to possession of the properties derives from its fee title.  Sherrill argues that the Oneidas' open market purchase of fee title is inconsistent with federal set aside and superintendence.
Sherrill contends it is entitled to summary judgment solely based upon the properties at issue being found not to be Indian Country pursuant to § 1151.  Because it has been found that the properties are Indian Country, Sherrill's motion for summary judgment must be denied.
Accordingly,  Sherrill's counterclaims are barred by the Nation's sovereign immunity.  The Nation is entitled to summary judgment on its taxation and due process claims.  It is further entitled to summary judgment dismissing the counterclaims brought against it.

Oneida Indian Nation of New York case still weren't sure why the court agreed to take up the case in the first place, and they were beginning to suspect the justices themselves weren't sure either.
The Oneidas are pursuing a separate land claim for 270,000 acres taken illegally by New York state in the early 19th century, and the Supreme Court itself in the mid 1980s twice upheld the Nation's right to bring the suit.
One scenario advanced by New York Times Columnist William Safire is that President Bush would elevate Scalia to chief justice and attempt to dampen opposition by promising a more moderate appointment to the empty seat.

 ORDINANCE RE
The Code of Ordinances of the City of Sherrill, consisting of ordinances numbered 1 - 23 inclusive is hereby adopted and enacted, and shall supersede all other general and permanent ordinances of the City relating to the same subject matters enacted on or before March 1, 1983, except as hereinafter provided.
The lots on Sherrill Road shall be numbered from the State Road at the West Shore crossing towards the south by blocks, progressively, as the 100 block, 200 block, etc. Odd numbers shall be on the westerly side of the road, even numbers on the easterly side.
Pursuant to the provisions of Section 90 of the Vehicle and Traffic Law of the State of New York, as amended, the Police Department of the City of Sherrill is hereby authorized to regulate, and designate, by an appropriate sign, the right-of-way on and in, any street intersection within the City of Sherrill.
