The solution which McAlpine was forced to adopt was to issue what it described as a "short order" whereby Emcor would be placed under contract to commence and carry out works up to a limit of value initially set at £1 million.
At this point McAlpine issued a further order in the value of approximately £20 million as an addendum to the previous orders indicating that it believed Emcor now to be under a duty to carry out and complete the entirety of the works for the total amount of orders now placed.
McAlpine replied by stating that they considered Emcor to be in repudiation of their subcontract, and indicated its acceptance of that repudiation.

McAlpine claims these rules were broken because Bovis had submitted the highest tender - at £6.2 million plus fees of 1.25 per cent of the construction cost - yet it still won the contract.
An SPCB spokesman said: "Sir Robert McAlpine is claiming for the sum of £4.31m, a substantial sum that would have to be found from the public purse if this action is pursued and is successful.

The defendant was a subcontractor whose function it was to construct a certain amount of the steelwork for what is called a brise-soleil, which I understand to be a device for preventing the surface of the building from heating up.

Sir Robert McAlpine has today (Wednesday) launched a £4.31m damages claim against the Scottish Parliament for failing to secure the £50m Holyrood parliament building project.
The announcement was made during a brief court hearing in which Judge Lord Clarke allowed both sides in the case time to adjust their pleadings with a preliminary hearing set for 23 March.
Sir Robert McAlpine, which is also seeking interest on the damages claimed and the expenses of the action, claims that the "sole criterion" for the award of the contract was bound to be lowest price.
