By 1990 both Rupert Murdoch's Sky Television and the BSB alliance were beginning to struggle with the burden of massive losses.

Sky is allowed to restrict certain channels such as Sky Sports Xtra to its direct customers, who are also able to use certain interactive features of its programming which are not available to cable viewers.

Order of the Court of First Instance (First Chamber) of 28 November 1991. Eurosport Consortium v Commission of the ...
In the statement of claim served on Sky Television on 30 July 1991, the two plaintiffs specifically rely upon the Commission' s finding in the contested decision of an infringement of Article 85 in support of their claim for damages.
In Sky Television' s opinion, the contested decision will form an important element of any decision in the High Court action, and its legal position will therefore be directly affected by the final decision of the Court of First Instance.
Sky Television' s interest, as an addressee of the contested decision, is confirmed by the fact that it enjoyed an independent right of action under the second paragraph of Article 173 of the EEC Treaty (order of the Court of Justice of 28 January 1987 in Case 150/86 Usinor and Sacilor v Commission, not published).

Political sensitivities led to the channel bringin the use of the abbreviation UTV to the fore, as the use of word 'Ulster ' is controversial among Northern Ireland's two communities.

However, while UTV has been available to the whole of the United Kingdom via the Sky Digital system since 2001, it is not yet available on satellite in the Republic, owing to rights issues, as many ITV programmes are also shown on the commercial channel TV3, which is partly owned by ITV plc.
