In April 1994, university administrators first became aware of the possibility of NCAA rules violations in the men's basketball program when an international student advisor reported to the director of athletics that an international men's basketball student-athlete had an outstanding university balance for the 1994 spring semester.
On December 30, 1996, Slippery Rock University filed a timely notice of appeal with the Division II Steering Committee, requesting that the appeal be based only on the written record.
In its notice of appeal dated December 30, 1996, Slippery Rock indicated its belief that its self-imposed penalties and corrective actions were substantial and that any penalty imposed after the 1996-97 academic year would be excessive and inappropriate for the infractions involved.

Slippery Rock argued that its self-imposed penalties and corrective actions were substantial enough and that limiting financial aid awards after the 1996-97 academic year was too excessive and inappropriate.
The original decision concerning Slippery Rock was issued by the NCAA Committee on Infractions on August 10, 1996.
The Division II Steering Committee considered whether the penalties imposed on Slippery Rock were inappropriate or excessive based on the facts and circumstances of the case.

Levy concludes that at Slippery Rock "we do not have an environment that is conducive to academic freedom." More generally, he said that the fourteen campuses making up the Pennsylvania State System of Higher Education "have seen the steady erosion of academic quality and academic freedom."
The university's official website may proclaim that "Of all the accolades and special recognitions that the institution has received, it is most proud of its reputation as a caring and friendly university," but Levy hardly met a "caring and friendly" reception on his return from testifying.
Slippery Rock's president Robert Smith responded, "We have not found a body of evidence to suggest any threat to academic freedom for students or faculty on this campus." Director of Women's Studies Jace Condravy dismissed Levy's evidence: "I like to see proof before I believe anybody's accusations or claims."
