While the Cache Creek Plan bans commercial mining in the creek bed, some removal of aggregate may be required to maintain the flow depth of the main channel (which continues to collect aggregate, washing down from the head of the river), to protect against wash-outs of agricultural land, and to protect bridges along the river.
The problem with the SMARA requirements is the speed of the process; the Cache Creek Plan anticipates small projects to shore-up a bank or re-align the river, which would be conceived, planned and carried out within the summer months, from April or May through October or November.
This legislation is needed because SMARA does not allow for a plan, such as the Cache Creek Management Plan, to serve as a Reclamation Plan.

In general, SMARA seeks to ensure that mines are operated in a way that permits the land to be effectively reclaimed at the end of the mine's useful life.
Because DOC is ultimately responsible for overseeing SMARA, and since the state has an interest in ensuring that SMARA is enforced fairly and evenly for all the mines of the state, we believe that DOC should have the ability to take action when a SMARA document is clearly deficient.
State administration of SMARA is funded from two sources: The Surface Mining and Reclamation Account (which receives a portion of federal payments from mining activities on federal lands) and the Mine Reclamation Account (which receives the annual reporting fees from mine operators).

SMARA is a fascinating but obscure state law whose history suggests the power of California’s mining industry.
Dating back to the heady, progressive Governor Jerry Brown days of 1975, it has two functions: in a concession to mining interests, it identifies mineral deposits statewide and protects them from development; but, more important, it requires all active mining companies to submit a site-reclamation plan to their city officials.
Sully-Miller was indeed active when the act was passed in 1975, so under the 12-year stipulation, the company had until 1987 to submit a reclamation plan.
