Before the arrival of the Soulbury commissioners, a special session of the Ceylon National Congress was held on September 2, 1944 at the Town Hall, Colombo.
The Soulbury commissioners by means of advertisements in newspapers invited the public to submit proposals designed to give effect to the declaration of May 26, 1943, and to send in criticisms of any such proposals as had been made public, on or before January 15, 1945.
The soulless Soulbury Commission report, which boasts of the protection it provided to the minorities, was a borrowed fragile version from the Board of Ministers' Draft Constitution of 1945.

Discussions had continued to take place with representatives of the staff on Soulbury conditions of service and it had been recognised that the recruitment and retention difficulties, particularly when the current salary ranges were compared with those for staff on the Leadership Group for teachers, were now acute.
It was necessary to ensure that staff were not disadvantaged and that recruitment and retention problems were being addressed since the differential between the two salary spines, particularly in respect of attracting senior staff from middle, upper and special schools was a continuing cause for concern, notwithstanding Structured Professional Assessment.
The complexity of the role should not be underestimated; the requirements to challenge schools who were coasting and set stretching targets for high performing schools, a matter which was subject to comment in the Ofsted inspection of the LEA, meant that the service was constantly looking for innovation and improvement.

After analyzing the situation, one still finds it mystifying to observe that the Soulbury commissioners failed to provide a form of government where the minority communities, too, could participate in the day-to-day administration of the country they rightly belonged to, and hold on to power and position, and also their individuality, dignity and honor.
For this act, subsequently, Lord Soulbury was rewarded with the position of Governor General after the independence of Ceylon, as a measure of gratitude for his loyalty towards D S Seananayake.
Earlier, the Soulbury Commission recommended that the franchise be within the exclusive jurisdiction of the Ceylon parliament, and further advised that no change be made for the first election.

As you are aware the successive governments in Sri Lanka, dominated by the Sinhalese, have systematically usurped the rights of the Tamil people, which they had at the time of independence from the United Kingdom in 1948.
The Tamil people accepted the constitution drafted by the British (Lord Soulbury) at independence, primarily because it contained a protective clause [Section 29(2)], and also because it provided recourse to the Privy Council in the event the protections afforded by this constitution were violated.
In 1972, Section 29 was abolished with the repeal of the Soulbury constitution and enactment of the Republican constitution.

Recognizing the general state of apprehension and suspicion in the minds of minority communities when power was to be transferred from neutral British hands to the people of a country, the commission became alert to the need for minority safeguards.

Soulbury Commission Found Sri Lankan Tamil Claims of Discrimination Baseless
The Sri Lankan Tamils brought charges of discrimination before a Commission headed by Lord Soulbury, appointed by the British Government in 1945 to review Constitutional Reform when Sri Lanka (then known as Ceylon) was still a colony of the British Empire.
The Soulbury Commission drew a parallel between the United Kingdom and Sri Lanka to illustrate that the measures taken by the Government of Sri Lanka were not deliberate efforts to discriminate against the Sri Lankan Tamils, but instead, were measures adopted to redress past injustices perpetrated on the larger Sri Lankan nation.
It is clear that social justice for the larger Sri Lankan nation had to necessarily impact adversely on groups such as privileged ethnic minorities or the economically privileged.
