  05-6072 -- U.S. v. Souvannarath -- 12/14/2005
Khamphay Souvannarath pled guilty to being a felon in possession of two firearms, in violation of 18 U.S.C. § 922(g)(1), and to possession of methamphetamine with intent to distribute, in violation of 21 U.S.C. § 841(a)(1).
Souvannarath argues that the district court failed to adequately consider the sentencing factors set forth in 18 U.S.C. § 3553(a), and as a result, it imposed an excessive sentence.
In light of Souvannarath's status as a career offender under U.S.S.G. 4B1.1, a total offense level of 29, and a criminal history category of VI, the presentence report calculated his guideline range to be 151 to 188 months.

A Superior Court judge has ruled that officials in Fresno County, California, cannot jail tuberculosis (TB) patients who refuse to take their medicine, unless they have been accused or convicted of a crime.
The ruling provided Hongkham Souvannarath, a Laotian refugee with noncontagious TB, with some reparations after spending 10 months in jail for not taking her medication.
The ruling of Judge Donald Black does not solve the question of where to put patients who refuse to take their medication, since they can develop drug-resistant strains of the TB and spread the disease to others.
