Space law is an area of the law that encompasses national and international law governing activities in outer space.
The inception of the field of space law began with the launching in October of 1957 of the world's first satellite, the Union of Soviet Socialist Republic's Sputnik.
The advent of commercial space activities beyond the scope of the satellite communications industry, and the development of many commercial spaceports, is leading many countries to consider how to regulate private space activities.

 Air and Space Law
Space law developed into a topic which was to be covered frequently by Soviet researchers in Russia and its satellite states.
The Outer Space Treaty dates from 1967, an elaboration resulted in the 1979 Moon Agreement in which international use of the moon and exploration of its resources in particular were addressed.
Today's space law is one of the newest branches on the tree of international law and follows developments in space technology.

A concept such as national sovereignty is benign in space, but the inhabitants of Earth still carry on their everyday existence with wars over which boundary is correct, which people should rule a piece of land, and which people should die because they happen to occupy the land.
During the early days of the space program consensus was much easier to obtain and with this consensus came some of the most far-reaching international agreements ever formed.
The Outer Space Treaty states that space is the "province of all mankind." Space is available for the exploration and the use of everyone; no one nation can restrict the access of space to any other nation.

 Existing Space Law Concepts
Space Law requirements have been proposed by the United Nations for the human settlement, scientific discovery, and industrial explorations on the terrestrial moon and on Mars.
International law may set the framework for outer space law, but when it comes to governing a large number of individuals in space, with manufacturing and mining occurring in remote areas, a different set of laws for regulating relationships will be needed.
Even when self-sufficient colonies exist, the basis of the laws that we have evolved on earth should be the basis for life in space, to ensure the protection of earth citizens, wherever they travel to these colonies, and to ensure only minimum or necessary exploitation of Mars, the asteroids, or eventually other planets.

 The Law of War in Space
The former law applies to conflicts that the belligerents themselves may not regard as "wars." [n133] The latter law is of relatively recent origin and is expressed most authoritatively in Article 2(4), and Chapter VII of the United Nations Charter.
If it did, then not only would such "law" never have achieved the force of law in the first place, [n175] but the jus in bello would prohibit all means and methods of war for the simple reason that any one of them are apt to produce suffering to some extent.
As distinguished from "Astrolaw," [n293] space law is limited to "the regulation of those activities by States in outer space which are, by nature, essentially international." [n294] This remains true despite the rise of both public and private efforts at commercialization of space.

Tonight's episode of The Space Show, a radio/podcast program, is devoted to a panel discussion on space law topics, in particular space property rights.
One speaker also noted that international law accepts a "zone of safety" around oil rigs in international waters, and there is also international recognition of "economic exclusion zones" around countries' coastlines to protect fishing resources.
The speakers also connected the discussion of the Moon and property rights to other aspects of space law, such as satellites in geosynchronous orbit or experiments conducted onboard the ISS, where private property rights are also respected.

Current discussions about the application of International law to the issue of space usually focus on two treaties, the Outer Space Treaty (1967) and the ABM Treaty (1972).
We need to demand that current laws regarding military activities in space be observed by all nations regardless of their relative size or political power.
The principle contained in the Outer Space Treaty is the "province of all mankind." (Article 1, paragraph 1) Nowhere in the Outer Space Treaty is the common heritage principle mentioned.

If you ask the Professor if space is pork (and I did), he will quickly respond (in inimitable lawyerly fashion), "sometimes," and then refer you to his writings about "moneysaving and capability-improving" ideas for NASA.
He strongly supports private space ventures and calls for a leaner and meaner space agency in which Mike Griffin does "some serious restructuring and refocusing..." The professor emphasizes, "I think the focus on exploration, as opposed to pure science (or pork) is vital to humanity.

WASHINGTON (States News Service) - The commercial space industry and the U.S. government should start considering changes to existing international space law, a State Department official said in a speech Tuesday night.
Law governing the space industry was formulated at the United Nations during the Cold War in the late '60s when space was dominated by government launches.
Besides the International Space Station, a project that has involved foreign negotiations, Brill said the State Department has a number of space projects in the works.
