		It appears from this proceeding that it is the purpose of the petitioner to build an extensive dam across a non-navigable stream running through Mayes county, known as Spavinaw creek, for the purpose of impounding the waters of said creek so as to create a water supply for petitioner and its inhabitants.
		The Oklahoma Legislature in the regular session of 1923 passed an act providing that in building and enlarging waterworks plants a margin of not to exceed 660 feet above the high water line might be appropriated for protection of the reservoir.
		It seems that this act is not applicable to this case; but it does indicate that the Legislature of our state recognized that some margin is necessary; and it is rather a legislative declaration of a necessity that already existed, than a necessity created by legislative act and based solely and alone upon the act.
