The action alleged that the Mobil refinery in Chalmette, Louisiana negligently discharged hydrocarbons into the Mississippi River in January 1998, and that the pollution made its way into the water treatment system owned by St. Bernard Parish, harming the citizens.
The action made it all the way to the Louisiana Supreme Court, where the court determined that the insurer was liable for any sums that the parish owed.
Several residents sued the parish, alleging that the parish was negligent for failing to detect the contaminants, which they claimed caused them personal injury by toxic exposure through consumption and use of the polluted water.
