Stanley Griswold   (Site not responding. Last check: 2007-10-13)
Stanley Griswold (November 14, 1763 - August 21, 1815) was a Democratic-Republican politician from Ohio.
After serving in the territorial government of Michigan from 1805-1808, Griswold moved to Ohio, and was appointed to the Senate to fill the vacancy created by the resignation of Edward Tiffin, serving from May 18, 1809 until a special election was held to choose a successor on December 11, 1809.
Griswold then moved to the Illinois Territory, working as a judge and lawyer until his death.

Adoption History: Stanley v. Illinois, 1972
Stanley appealed, claiming that he had never been shown to be an unfit parent and that since married fathers and unwed mothers could not be deprived of their children without such a showing, he had been deprived of the equal protection of the laws guaranteed him by the Fourteenth Amendment.
The Illinois Supreme Court accepted the fact that Stanley’s own unfitness had not been established but rejected the equal protection claim, holding that Stanley could properly be separated from his children upon proof of the single fact that he and the dead mother had not been married.
Stanley’s claim in the state courts and here is that failure to afford him a hearing on his parental qualifications while extending it to other parents denied him equal protection of the laws.

The Right of Privacy: Is it Protected by the Constitution?
In 1969, the Court unanimously concluded that the right of privacy protected an individual's right to possess and view pornography (including pornography that might be the basis for a criminal prosecution against its manufacturer or distributor) in his own home.
In Ravin v State (1975), drawing on cases such as Stanley and Griswold but also basing its decision on the more generous protection of the Alaska Constitution's privacy protections, the Alaska Supreme Court found constitutional protection for the right of a citizen to possess and use small quantities of marijuana in his own home.
Earlier decisions such as Griswold and Roe suggested that states must show a compelling interest and narrowly tailored means when they have burdened fundamental privacy rights, but later cases such as Cruzan and Lawrence have suggested the burden on states is not so high.

However, all contemporary candidates for office with minimal residency in their chosen state, must be measured against the case of Senator James Shields, who was the only Senator elected from three different states: [D-Illinois] in 1849; [D-Minnesota] in 1858; and finally, [D-Missouri] in 1879.
