State aid policy is covered by the competition rules of the EC Treaty and serves the same purpose as competition policy, namely to ensure an efficient use of society's resources.
For this reason the state aid area is under the auspices of the Danish Competition Authority.

State aid can be a complex subject, but there is a surprising amount of scope available to support a wide range of bodies, provided some time is spent at the outset to determine the best fit.
Aid paid as de minimis does not have to be linked to the eligible costs of a project in the way that aid under many approved state aid schemes does; the aid goes to the recipient firm directly, not towards a project.
The Commission found that aid for a leisure pool in Dorsten, Germany, had no effect on trade between Member States (one of the 5 tests that must be met for aid to be a "state aid") as pool users would not travel more that 50km to use the facilities.

To ensure consistency and equality of treatment between Member States in the application of the state aid rules to measures relating to direct business taxation and to ensure that Commission decisions are transparent and predictable.
After examining the compatibility of tax aid with the common market, the Commission could not, however, authorise aid which proved to be in breach both of the rules laid down in the Treaty and of the provisions of secondary law on taxation, such as the code of conduct.
Member States are required to notify the Commission of all their plans to grant or alter aid and may not put such plans into effect without the Commission's prior approval.

State aid gives certain firms an advantage over their competitors in other countries not receiving such aid, although competitors are subject to the same environmental constraints.
The guidelines also state the criteria the Commission applies in assessing whether state aid of various types for environmental protection is compatible with Article 92 of the EU Treaty.
Aid may be granted only to plants which have been in operation for at least two years after new standards entered into force.

State Aid to Virginia's public libraries began in 1942 with an appropriation of $50,000.
To receive an annual state aid grant a library must apply for the funds prior to June 1 and the library must meet a set of requirements, adopted by the Library Board.
The State Library may require that the amount of such reduction in the library's total expenditure be subtracted from the library's eligibility and that the state grant be reduced accordingly.

The new state budget puts state aid for libraries at $58 million and provides that each library will receive a 20 percent to 21 percent increase in state aid from the previous year.

The Commission therefore ordered the Member States concerned to discontinue the tax regimes immediately with respect to new entrants and to phase-out the schemes with regard to existing beneficiaries by 31 December 2010 at the latest.
The Commission did not order the Member States concerned to recover the tax benefits granted so far because these Member States and the beneficiaries had legitimate reasons to believe that the special tax regimes were lawful: in 1984, the Commission had considered that the Belgian Co-ordination Centres regime did not constitute state aid.
With regard to the cost plus method provided for by the revised scheme, the Commission found that its practical application does not amount to State aid because, unlike the original scheme, the Centre’s taxable income is calculated on the basis of all its operating costs, to which an appropriate mark-up rate is applied.

It determines the allowable aid objectives, costs to be supported and maximum aid intensity, as well as national State aid control procedures, in order to lessen the negative impact of State aid on competition and to prevent the possibility of obtaining economical advantages by receiving unlawful aid.
