Franklin v. State (Roaf, J.) CACR97-486   (Site not responding. Last check: 2007-09-17)
Although Franklin's motion for directed verdict challenged the sufficiency of the evidence only for the charge of possession, a motion for directed verdict is not required in a bench trial to preserve for appeal the issue of sufficiency of the evidence.
State, 306 Ark. 417, 815 S.W.2d 382 (1991), the supreme court stated that there was substantial evidence of constructive possession when at the time of the raid Nichols was found seated at the kitchen table of his residence with drugs in plain view on the table in front of him.
Although the State argues in response that there was substantial evidence that Franklin had both knowledge and control of the cocaine found in the house and under the dog house, it relies upon the same authorities advanced in support of the conviction for possession.

Ricky Lee FRANKLIN v. STATE of Arkansas
He raises two points on appeal: (1) an insufficient foundation was laid by the State for the admission of two pieces of physical evidence; and (2) the evidence was insufficient to corroborate the testimony of an accomplice in that it failed to independently connect Franklin with the crimes.
Franklin is right that when accomplice testimony is involved, statutory law requires that there be other corroborative evidence "tending to connect the defendant with the commission of the offense." Ark. Code Ann.
Even though the State appears to have conceded that Franklin raised lack of corroborative evidence as part of his motion for directed verdict, we are not prepared to say that references in the State's Argument to what transpired at trial equate to an abstract of the record.

 TN Encyclopedia: STATE OF FRANKLIN
A short-lived attempt to create a new state in the trans-Appalachian settlement of present-day East Tennessee, the State of Franklin arose from the general unsettled state of national, regional, and local politics at the end of the Revolutionary War.
Sentiment for such a movement had been growing among the western residents largely as a result of the distance between their settlements and the seat of government, which made it difficult for eastern legislators to understand the complexities of trans-Appalachian life and for settlers to obtain relief for their complaints.
North Carolina continued its policy of reconciliation by allowing the locally popular Sevier to be seated in the legislature as the representative from Greene County; as a further gesture of goodwill he was appointed brigadier general of militia for Washington County.
