 | | No conviction for rape or statutory 34 rape can be had against one who was under the age of fourteen (14) years at 35 the time of the act alleged, unless his physical ability to accomplish pene- 36 tration is proved as an independent fact, and beyond a reasonable doubt. |
 | | In 45 prosecutions for the crime of rape or statutory rape, evidence of the prose- 46 cuting witness' previous sexual conduct shall not be admitted nor reference 47 made thereto in the presence of the jury, except as provided hereinafter. |
