05/06/96 LAW CREEPS ONTO THE LAWLESS NET
Online users have multiplied twentyfold from 1 million in 1988, and commerce on the Net is expected to reel in $45.8 billion by 2000, up from an estimated $2.2 billion last year.
With such a law, essentially all activity in cyberspace--especially the relaying of online discussions over the thousands of computer-to-computer links--would be open to charges of infringement.
Online service companies, which function as access points to the Net, are caught in the middle.

Online NewsHour: Saving Steel? -- March 6, 2002
RAY SUAREZ: The National Steel Company of South Bend, Indiana, today announced it had filed for protection under federal bankruptcy laws, yet another example, say industry and labor leaders, of why protective tariffs on imported steel are necessary.
Now, if the Administration and the Steel Caucus in both the House and Senate lead the charge to help us get pensions and retiree health care taken care of like they are in every other major industrialized world, we'll be able to restructure the industry during that three year period.
There are separate laws that deal with dumping and subsidization that have often been used by the steel industry.

Online NewsHour: Analysts Discuss First Day of Samuel Alito Confirmation Hearings -- January 9, 2006
Two constitutional law scholars analyze opening statements on the first day of Senate hearings for Supreme Court nominee Samuel Alito, including questions over his judicial philosophy and views on executive power.
And the two most important things and very appealing things that Judge Alito said were, first, that the rule of law is fundamental and the role of the judge is quite different from the role of the lawyer, and that the role of the judge is to be independent of agendas and clients.
Judges should be restrained and defer to statutes and laws passed by Congress and the states.

1998 SHGAPE Presidential Address   (Site not responding. Last check: 2007-11-03)
Courts' treatment of legislation reflected the nineteenth-century common law's deep suspicion of statutes, a firm commitment to the superiority of judge-made law to legislative enactments, and a zealous conviction that law must be administered in common-law courts.
Law itself could only be articulated by judges; both judicial precedents and statutes were only sources of the law, not the law itself.
Judicial expositions of law did not equal the influence of academic expositions of the Justinian Digests, or Pendects, the study of which became the central occupation of German jurisprudence in the nineteenth century, but decisions were nonetheless studied and cited.

The Common Law was expounded over the years in hundreds of thousands of case decisions as a result of trials in which the Common Law jury acted as the Judges, and in which they exercised the authority to hear and decide questions of both Law and fact.
The Judge in a Court of Common Law is an impartial referee of the dispute, and he is bound to protect the Rights of the parties to the dispute, or he will have lost whatever jurisdiction he may have had, or claimed to have had.
And the Common Law of the States may not be modified, limited nor abrogated either by an act of the legislature (Congress or State Legislature) or by a ruling of some judge or by any county board of commissioners or any other servant to the people.

As a result, few developers realize that they are infringing a patent until "they get the letter from the law firm that they've never heard of in the city they've never been to that says they are infringing US Patent Number so-and-so," says Robert Merges, a professor of patent law at Boston University.
Unfortunately, the idea frequently backfires: soon after examiners earn their law degrees, they frequently leave the government for a lucrative job in private practice on the other side of the patent bar.
By law, patents give an assignee a legal monopoly to practice an invention and to sell or import devices that embody the invention or are made through its use.

PPS argued that Deschene waived his right to a judicial forum when he personally signed a collective bargaining agreement that contained an arbitration clause.
The court rejected this argument, stating that an individual employee may agree to submit their rights to arbitration but a union may not waive an employee's right to a judicial forum in negotiating for a CBA.
The fact that Deschene acted as a figurehead for the union by signing the CBA did not compel the court to believe that he was personally agreeing to arbitrate any state law claims he may have with his employer.
