Stelco's tacit assertion that it was caught totally unawares by the court's inquiry into the timeliness of its 1992 refund claim is flatly inaccurate.
In the aforesaid submission, Stelco volunteered a copy of a formal administrative claim for refund (Form 1120X) for its taxable year 1992, which plainly revealed that it was filed on or after December 17, 1996, well after the three-year statute of limitations under § 6511(a) had expired in mid-September of 1996.
Ironically, in a series of filings spanning several months, Stelco emphatically beseeched the court to weigh the adequacy of its administrative refund claims for the taxable years 1984-1986 and 1989-1995 not on the basis of the four corners of those filings, but against the totality of the surrounding circumstances.

Stelco said Friday it filed documents with the Ontario Superior Court of Justice seeking approval to discontinue the capital-raising process related to its core steelmaking business and to replace it with a financing plan involving new equity, new debt or a combination of both.
Stelco recently issued financial estimates saying fourth-quarter operating earnings would be in the range of Canadian $45 million to C$50 million ($37 million to $41 million) in contrast to an operating loss of C$138 million in the fourth quarter of 2003.
Stelco, which missed the March 31 deadline for filing financial statements due to matters related to its CCAA protection, said it expects to file the completed financial documents by April 14.

Pratt said Stelco continues to expect "significantly" higher operating profits for the remainder of the year, but he warned there is "increasing uncertainty" about global steel markets in the second half.
Stelco estimated in March that its 2005 operating profits would be in the range of $350 million to $400 million but Pratt said the company is currently reviewing that forecast.

Stelco suitor OAO Severstal of Russia has made a similar court filing on the grounds that Stelco's management has thrown up roadblocks to it completing the due diligence for its own offer, believed to be worth about $1 billion.
Using the fact that Stelco has raked in $100 million in profits over the past two quarters, the union has argued that Stelco was never in as bad a shape as management claimed.
Stelco has denied this claim and said its recent profitability is the result of a short-term improvement in the market that will not last.

Stelco Canada Works (March 2004): In 1913, the Steel Company of Canada opened a mammoth new steel mill in what was then the township of Barton.
Stelco produced a heck of a lot of shells to help destroy German industry and a heck of a lot of ingots to help build up Canadian industry, but once those jobs were done, in 1984, Stelco ceased production at the mill.
Over the next two years the mill's usable equipment was stripped away and sent to other Stelco properties; the place was fully abandoned in 1986.
