In 1982 Mr Spencer refused public access over his property to part of the 7.3km road and the historic Stony Batter gun emplacement and tunnels.
Councillor Greg McKeown, the council’s Transport Committee chairperson, says the decision is the final chapter in a long-running saga and, although the road has been open to the public since last July, the Privy Council decision confirms the legality of public access to the road.
"The council is pleased that the road will continue to be used by the public to visit the historic Stony Batter and some of the beautiful bays on that part of the island," he says.

We have limited space on the bus (our contingent at camp is 35) but families are most welcome to join us and travel by private car, again this will have to be privately arranged.
The bus will leave Stony Batter at 3.00pm and call in at Woolworths on the way back so Cubs and Scouts can do some shopping.

The Stony Batter Protection and Restoration Society have begun restoring the superb complex of tunnels and gun emplacements at Stony Batter in eastern Waiheke.
The site was built for coastal defence in WWII, to provide safe harbour for allied shipping, and protection to Auckland from sea- borne attack.
It is planned to obtain a special ferry rate for Stony Batter volunteers, and land transport out to Stony Batter is available if we receive advance notice of persons arriving to assist.

Karen & I did an exhaustive drive around the island, and I now have a grip on the geography, and also feel confident that our house is in the best part of it!
Yesterday Jan, Dennis & I went on an expedition to Stony Batter, at the eastern tip of the island, where the biggest network of WWII defensive tunnels and gun emplacements in NZ was built.
We were the only ones there and had great fun making scary noises in the tunnels.
