GO Transit's Notice of Motion requests the Agency for a ruling on the suspension and deferral of the application for a road crossing at the proposed Park Drive and dismissal of the application for a crossing at the proposed Hoover Park Drive.
GO Transit maintains that the OMB's obligations to exercise its broader jurisdiction under the policy direction of the Planning Act, the Provincial Policy Statement 1997, and the Region of York and Town of Whitchurch-Stouffville Official Plan are not overridden by the Agency's power pursuant to section 101 of the CTA.
GO Transit and CN are required to file their answers to the application on or before September 20, 2004 and to serve a copy on the applicant.

GO Transit notes that clause 3.1 of RDT 10 requires the consideration of alternatives and an evaluation of all factors that may impact on the safety of the crossing.
GO Transit also submits that according to an independent land use planner retained by GO Transit, the subdivision design incorporating two at-grade crossings does not represent good planning, is not in the public interest, and is not consistent with the municipal, regional or provincial policies.
GO Transit adds that the construction costs for any new crossings should be borne by the party creating the need and that the Hoover Park Road crossing is a new extension necessitated by the Town's growth.

GO Transit took over the service on September 7th, 1982 when the service (as well as similar services to Barrie and Peterborough) was slated for abandonment during a round of cutbacks at VIA Rail.
The initial GO Stouffville service was as modest as the VIA run, with one train running from Stouffville to Union Station in the morning and one train making the return trip in the early evening.
GO purchased the tracks from Stouffville to Uxbridge to prevent their abandonment and thus maintain the possibility of GO Train service to Uxbridge.

Along Yonge Street the "Yellow A" service was express, while "Blue B" was semi-express and "Red C" was local, with the bus stops colour-coded accordingly.
("Black D" was never used.) Red was chosen as the color for the local service so that it was not necessary to modify the old Toronto Transit Commission bus stop signs north of Steeles Avenue.
