III. Sui generis Systems: Effective to Achieve the Objectives and Principles   (Site not responding. Last check: 2007-09-07)
Also, what "sui generis system" satisfies the obligation is unclear and a subject of differing views.
Sui generis systems adopted by developing countries, on the whole, go contrary to UPOV 91 in several respects; they would prefer UPOV 78 (whose "membership", at 29, still far exceeds UPOV 91, at 16).
To be effective, provisions in sui generis systems should be complemented by provisions on protecting intellectual property rights such as patents, because these could be a way around the sui generis rules.

South Bulletin 34 - The Relevance of Sui Generis Systems to Africa
The title of his full presentation was "Sui Generis" systems: The case of the "OAU Model Law on the protection of the rights of local communities, farmers and breeders and for the regulation of access to biological resources".
Even though the concept "sui generis" confers uniqueness (of its own kind), the operators of the formal systems of protection were hardly prepared to accept any incursions into the single model with which they were familiar.
The concept and practice of "sui generis" as a form of protection in the new world order of trade and commerce is new to most African States.

GRAIN | Seedling | 1997 | TOWARDS OUR SUI GENERIS RIGHTS
Civil society advocates have been racking their brains to figure out whether and how this sui generis option could be used to enact Farmers' Rights or some other sui generis legal system to protect communities' intellectual rights and promote continued management of biodiversity at the grassroots level.
Sui generis rights are in total conflict with patent laws: either we protect communities' interests or we protect the multinational corporations.
We focused in particular on the sui generis rights option for intellectual property over plant varieties as imposed on all WTO member states by the TRIPS Agreement, as well as on other international agreements related to biodiversity such as the Convention on Biological Diversity (CBD).

For instance, a sui generis system for plant varieties must comply with the basic principles of national treatment, meaning that member states are obliged to grant to non-nationals the same advantages as to its own nationals.
A sui generis system that puts the emphasis on the place of invention could be in full compliance with the TRIPS principle of national treatment.
The linkages between the several sui generis approaches, as well as efforts to enable local communities to ground their rights in national and international legislations, are numerous.

sui generis Database Protection: Has Its Time Come?
First, the opponents contend that despite the outcry from some database companies that sui generis protection is necessary to protect their investments in compiling databases, adequate protection currently exists within the present intellectual property law framework.
Besides these general objections to sui generis protection for databases, the opponents had a list of specific concerns with H.R. It is, of course, too early to tell if these same areas of concern will remain with respect to new legislation, if and when it is introduced.
Because the bill permitted cumulation of copyright and sui generis protection, works that would normally be protected under the copyright laws would have been able to receive additional protection under H.R. The protection provided for these works under the bill was equally sweeping in nature.

NGOs hoped that these sui generis -- meaning of its own kind or unique -- systems might be developed in a way that could limit the influence of the limited 'blueprint' approach to protection that patents and PBRs offer, and provide some protection for traditional knowledge and innovation systems.
In looking for alternatives, we should take note that many of the proposals for sui generis system have made exactly the same assumption that many industrialized country representatives have made in the international negotiations: that protecting property rights over knowledge and biotic resources is equivalent to protecting knowledge and biotic resources.
Secondly, the problem with concept of intellectual property over knowledge and life forms is not whether it comes from the North or the South: but simply that the concept as such has never existed in indigenous or peasant systems....

 SIGNPOSTS TO SUI GENERIS RIGHTS
Any sui generis rights legislation which does not purposefully narrow or frustrate the operating field of the industrial IPR system, if not close off certain "territories", will do nothing to address the basic problem of biopiracy or the alienation of peoples' rights to control their local resources.
Another problem apparent in most current approaches to sui generis legislation is the dilemma of how to avoid that legislating rights in the race to please WTO or CBD or just to fend off biopirates leads to imposing an unwanted juridical personality on communities.
If sui generis rights related to biodiversity are to legally protect the space that belongs to communities, then they will need to recognise the collective nature of the resources, the knowledge and the innovations in question.

One of the favorite tropes of the blogging world, for instance, is the David vs Goliath story of the lone (self-taught, self-powered, grittily independent) blogger assiduously fact-checking Big Media or producing a devastating critique of some bit of mainstream science or other.
It’s the same story: the lone blogger is just another version of the artist without a past, upending the conventional wisdom with his special brand of outsider-status and sui generis credibility.
