The Supreme Court recently refused (Case T 2137-01) to grant the Civil Aviation Administration leave to appeal in a dispute between Scandinavian Airlines System (SAS) and the Swedish Civil Aviation Administration regarding payment for the construction of Terminal Two at Arlanda Airport.
The court concluded that the Civil Aviation Administration had abused its dominant position when charging SAS with discriminatory airport charges and thus breached Swedish and EU competition law.
The Civil Aviation Administration was ordered to repay SAS an amount of Skr600 million (approximately €65 million), releasing SAS from further payment liability for Terminal Two.
