Swedish nobility - Wikipedia, the free encyclopedia
The Swedish nobility (Adeln) were historically a legally privileged class in Sweden, part of the so-called frälse (a classification defined by tax exemptions and representation in the diet that also applied to clergy).
Following the elevation of a commoner into nobility by the Swedish monarch, the key concept was that of introduction to one's peers in the House of Knights (Riddarhuset), which formerly was a chamber in the Riksdag of the Estates, the Swedish Parliament.
The institution of Swedish (and Finish) nobility dates back to 1280, when it was stated in the Decree of Alsnö that magnates who could afford to contribute a mounted soldier to the cavalry were to be exempted from tax - at least from ordinary taxes - just as the clergy already had been.

Swedish law, drawing on Germanic, Roman, and Anglo-American law, is neither as codified as in France and other countries influenced by the Napoleonic Code, nor as dependent on judicial practice and precedents as in the United States.
The Swedish Government generally respected the human rights of its citizens in 2001, and the law and judiciary provide effective means of dealing with individual instances of abuse.

It is a general principle in Swedish law as mentioned in a previous post that a purchaser of real estate has an obligation to investigate the real estate thoroughly.
The purchaser is not able to claim that he should be entitled to rescind the purchase contract nor to compensation for “hidden defects”, if such defects would have been possible to find at a competent investigation of the real property prior to the purchase.
According to Swedish law the seller is responsible for all defects.

Swedish courts are considered to have jurisdiction even if an offence is committed partially in Sweden and partially abroad, which leads to a substantial extension of the principle of territoriality.
In Swedish law, the possibility to seize and confiscate drugs, substances and equipment used for criminal purposes is granted by articles 6 and 7 of the Narcotics Penal Act and by articles 9-12 and 15-17 of the Smuggling Penal Act.

The personal register law and EU directive
The law was changed in November 1999 because of the massive criticism of the law.
The law specifies exceptions where the law is not valid: Wholly private registers handled by a single person for his or her personal needs, registers published in newspapers, books or broadcast programs, registers used only by journalists, authors or artists.
The law may not be as dangerous as it sounds, since there has been a very heated debate about the law in Sweden, and it is possible that the law will not in reality be upheld in ways which endanger freedom of speech.

As under EC law, the previous system of notifications to the Competition Authority is abolished and replaced by a ‘self-reliance’ system under which companies must decide themselves whether their agreements and conduct are unlawful.
The Swedish rules on control of concentrations are very similar to the corresponding EC law rules, including the concepts of ‘concentration’ and ‘undertakings concerned’, the principles of turnover calculation and the treatment of ancillary restrictions.
In a landmark case described in previous editions of this publication, the Swedish Civil Aviation Administration (Luftfartsverket) was found to have abused its dominant market position in violation of Article 82 of the EC Treaty (as well as the corresponding Swedish prohibition) through price discrimination in relation to the use of Stockholm’s Arlanda airport.

RedOrbit - Science - Capri Marine Ltd. V. Chief State Prosecutor
In considering the question of Sweden's jurisdiction-as a matter of international law-to impose the pollution fees, the Supreme Court noted that, under Article 217(4) of the LOS Convention, it is the flag state that initially has the responsibility for investigating violations by its vessels and, if appropriate, for instituting proceedings.
According to the Court, the law's requirement of charging the owner or operator of the ship- instead of charging the person who is actually responsible for the discharge-supports the conclusion that actual contact with, and inspection or detention of, the vessel in the EEZ is not necessary for imposing a water pollution fee.
As of that date, however, Swedish jurisdiction was extended by chapter 10, sections 10-11, of the Water Pollution Act to cover such crimes, with certain limitations that reflect relevant provisions of the LOS Convention.
