Court TV Library: Miscellaneous Cases -- Survivors of Nazi Regime Sue Swiss Banks for Seized Assets
The Swiss banks knew that the agents and representatives of the Nazi Regime and the Regime itself was looting and plundering the assets of others in furtherance of their war crimes, crimes against humanity, crimes against peace, and genocide.
The Swiss banks engaged in a common scheme or conspiracy in furtherance of their objective of profiting from their activities in aiding and abetting, or acting in complicity and collaboration with, the Nazi Regime with respect to looting and slave labor activities.
The banks acted in concert, and engaged in a common set of practices to prevent and derail inquiries by heirs of victims of Nazi Regime atrocities whose assets were deposited in Swiss bank accounts, and by persons whose assets were looted and cloaked by the Nazis and placed in Swiss bank accounts.

STATE BANK v SWISS BANK (1995)
Swiss Bank on the other hand claimed that State Bank of New South Wales had not acted on the faith of the receipt and knew or should have known that the funds were paid to it as principal.
Swiss Bank argued that unless interest was awarded at Australian rates State Bank of New South Wales would be unjustly enriched because it did not have to outlay Australian dollars to repay the judgment debt for principal (the principal) until long after December 1989.
Swiss Bank submitted that the cases which had established that view of the section were not relevant where the benefits derived by a defendant from the use of money ordered to be repaid exceeded the losses of the plaintiff.

 Maimann v. Maimann CA
The appellant agrees that there was a numbered account with Swiss Bank Corporation, but does not accept that that was the destination of any part of her brother's share of the trust fund.
As a consequence of the 1st Defendant's denial that the Claimant was the beneficial owner of the contents of the original Swiss Bank account, the Claimant seeks a declaration that the monies and securities in Swiss Bank account number 40839 belonged beneficially to the Claimant prior to and/or as at 22nd July 1988.
It is immaterial - under Swiss law - whether the origin of those monies and securities was, as the respondent alleges, his share of the trust fund established by his father in 1956; or whether, as the appellant noted, those monies and securities represented their father's savings.

A Swiss Bank Account - Facts and Fiction
To most people having a Swiss Bank Account is something for the super rich, crooks, dishonest government officials or just a good way of "hiding away one's ill-gotten gains." That's nothing but fiction and a common plot used over and over again in a lot of Hollywood's B movies.
Bank drafts are also acceptable, but avoid using bearer bonds or securities when making your deposit or you're required to file a lot of red-tape at tax time.
The Swiss consider tax evasion and many other "crimes" under US law as "political offences." Things like divorce, inheritance disputes and bankruptcy cases are examples of "private matters," and as such the secrecy of the account is protected from any legal action to verify the presence of, or attempts to seize any assets.
