Immigrants had rarely won cases at the Supreme Court during the Rehnquist Court--and there is a century-long history of cases announcing that Congress has "plenary power" in the immigration area, with a very limited role for the judiciary.
		Alexander Aleinikoff: Our current immigration law requires that aliens seeking entry demonstrate that they or their sponsors are able to support them for 5 years without public assistance.
		Alexander Aleinikoff: Under existing Supreme Court law, states may not generally discriminate on the basis of alienage--unless it involves a political activity, such as voting (the Court has interpreted this political exception rather broadly, also upholding laws prohibiting aliens from being teachers and probation officers).
