TSMC may be distracted because it is engaged in an increasingly acrimonious disagreement with China's Semiconductor Manufacturing International Corporation (SMIC).
TSMC believes that SMIC is conducting espionage and stealing trade secrets, and is taking SMIC to court in the U.S. SMIC has responded by denying any wrongdoing and by claiming that TSMC is engaged in "smear tactics" and "bullying." It is uncommon to see such behavior and language from major corporations.
TSMC made a name for itself in particular on the.18 micron node, which it put into full force while that was still the most prominant fab process in the industry, and they made claims to maintain parity with the leading edge of the industry, claims which very quickly fell apart.

TSMC has taken disciplinary action against the employees involved and has referred the most serious case, involving the unnamed former employee, to the Taiwan Criminal Investigation Bureau.
Over time, TSMC expects to increase its production capacity by 20 percent each year over the next five years as the company ramps up production in Taiwan using 300-millimeter wafers, according to Jack Sun, senior director at the company's Advanced Logic Technology Division.
The charges filed by TSMC against the former employee come as Taiwan's government wrestles with whether to lift restrictions on investment in 200-millimeter wafer plants in mainland China.

On another level, however, TSMC may be serving notice through the suit that it is ready to fight for its long-term interests in China, as it carries out plans to install 0.18-micron equipment at a Shanghai facility that today runs at only half its potential capacity of 70,000 wafers per month.
TSMC still derives 32 percent of its sales from the 180-nanometer node--the same node for which SMIC is expanding capacity and from which the Chinese foundry today earns 55 percent of its logic revenue.
TSMC alleges that SMIC is still using some of its trade secrets in most of its legacy processes and that the Chinese foundry has also used TSMC technology as the baseline for 130- and 90-nm processes.

TSMC made the latest allegation in its long-running legal battle with Semiconductor Manufacturing International Corp. over the alleged use of trade secrets in a letter submitted to the Superior Court of the State of California, dated Oct. 12.
TSMC issued the letter in response to a cross-complaint filed by SMIC in early September seeking damages for what it said was "TSMC's breach of contract and breach of implied covenant of good faith and fair dealing."
The court dispute began in late August when TSMC sued SMIC for breach of an agreement in 2005 that settled a patent dispute, and for misappropriation of trade secrets.
