These intrastate tariffing requirements must be met and the tariffs effective by April 15, 1997, for the LEC's payphone operations to receive the payphone compensation provided by the Payphone Reclassification Proceeding.
The Payphone Reclassification Proceeding concluded that state and federal tariffing of both the payphone unbundled features and functions provided to others and the unbundled features and functions provided by the LEC to its own payphone operations must be tariffed to avoid possible subsidies and discrimination.
Options and elective features must be federally tariffed in the same circumstances as features and functions must be federally tariffed, depending on whether they are provided on a bundled basis with the basic network payphone line (state tariff), or separately on an unbundled basis (federal and state tariffs).

 PRT: Tax-Exempt Tariffing Receipts
Expenditure incurred on or after 1 January 2004 on a long term asset (OT11025) that is expected to give rise to tax-exempt tariffing receipts (OT15810) is specifically excluded from being allowable expenditure by OTA83/S3A (OT15910).
The transitional provision ensures that the amount of tariffs that qualify as tax-exempt tariffing receipts are reduced by reference to any allowable long term asset expenditure in the transitional period that relates to tax-exempt business in respect of a user field.
In order to provide certainty for companies as to whether amounts received are tariff receipts or tax-exempt tariffing receipts it will be necessary for the participator and OTO to agree the “qualifying threshold” in respect of the user field.

The tariffing requirement would still be pretty empty because the would-be competitor would expect to be able to do better in a negotiation subject to arbitration than merely to bow to the telephone company's opening bid.

Rather it is desirable to plan for a gradual relaxation of these tariffing rules so that HKTC could be relieved of different degrees of regulatory oversight of its tariffs as the market becomes progressively more liberal.
The TA has not waived these tariffing rules for HKTC because it is clearly dominant and is likely to remain so for some time into the future.
