Tax avoidance/evasion - Wikipedia, the free encyclopedia
Tax evasion usually entails taxpayers deliberately misrepresenting or concealing the true state of their affairs to the tax authorities to reduce their tax liability, and includes, in particular, dishonest tax reporting (such as underdeclaring income, profits or gains; or overstating deductions).
Tax avoidance may be considered as either the amoral dodging of one's duties to society, part of a strategy of not supporting violent government activities or just the right of every citizen to find all the legal ways to avoid paying too much tax.
Tax evasion, on the other hand, is a crime in almost all countries and subjects the guilty party to fines or even imprisonment.

Tax Protest Movement -- Extremism in America   (Site not responding. Last check: 2007-11-07)
Tax protesters generally believe that either the income tax laws are in some way invalid or that they do not apply to most citizens; therefore, they believe they have a legal and moral right not to pay taxes.
A tax protester, however, regardless of whether he or she actually attempts to evade paying taxes, is someone who has become convinced that they have a moral, ethical or legal right or responsibility to refuse to pay taxes.
Tax protesters usually evade taxes and sometimes commit acts of violence, but a number of people involved in the tax protest movement have also engaged in a variety of scams and frauds designed to capitalize on the beliefs of other tax protesters and the greed of ordinary citizens.

 Tax Protester FAQ
The federal income tax is unconstitutional because it is a "direct tax" that must be apportioned among the states in accordance with the census.
The court decisions against tax protesters are all rendered by ignorant, corrupt judges who have a vested interest in maintaining the status quo because their salaries are paid by the income tax and they are not going to bite the hand that feeds them.
Tax protesters (and white supremecists) also argue that the phrase "subject to the jurisdiction thereof" excludes those born within the states of the United States because only those born in the District of Columbia and the territories of the United States are "subject to the jurisdiction" of the federal government.

In addition to arguing that the income tax is unconstitutional, tax protestors often claim that the Tax Court is an unconstitutional court, and that the income tax laws violate the individual's constitutional rights, such as the right of freedom of religion, the Fifth Amendment privilege against self-incrimination, and the Thirteenth Amendment's prohibition of involuntary servitude.
Tax protestors often point out that the word "individual" is not defined in the Code or regulations, and conclude that they are not individual U.S. residents or citizens subject to federal income tax.
In Cheeks, the taxpayer, who was convicted of tax evasion for failing to file income tax returns, argued that he was, in effect, "duped" by the tax protestor rhetoric and honestly believed that he was not a taxpayer under the Internal Revenue Code.

Frauds and Scams Introduction | Crimes of Persuasion - A Resource for Investigators
In 1895, the United States Supreme Court held that the income tax law, as it was then enacted was unconstitutional, because it taxed income from property, which was the same as taxation of the property itself (a direct tax) which made it unconstitutional since federal tax dollars are not apportioned among the States.
If, taxing income from property was the same as taxing the property itself (and it was, no matter what we think, since the Supreme Court said so), the assertion that the system was unconconstitutional was a "no brainer" because Article 1, § 9, Clause 4, of the US Constitution says:
In this regard and in retrospect, Benson’s position suffers from the fact that, whomever it was that turned him in, and for whatever reason, he was guilty of fraudulently collecting Social Security benefits and tax evasion as evidenced by the fact that he was indicted and convicted.
