Smucker’s Spreading Deception, Says CSPI ~ Newsroom ~ News from CSPI
In fact, says the group, Smucker’s “Strawberry Spreadable Fruit” is only 30 percent actual strawberries—and 70 percent fruit syrup from apples and pineapples, lemon juice concentrate, pectin, red grape juice concentrate and other unspecified “natural ingredients.” Likewise, its “Blueberry Spreadable Fruit,” again billed as “100 %” fruit, is only 43 percent blueberries.
Smucker’s line of “Simply 100% Fruit” simply isn’t 100 percent fruit, according to the nonprofit food watchdog group, the Center for Science in the Public Interest (CSPI).
CSPI today called on the Food and Drug Administration (FDA) to crack down on Smucker’s false labeling, and to require all food companies to declare the percentages of key ingredients on the label.

Boston.com / Business / Suit says Smuckers spreads not all fruit
It contends the "Simply 100 Percent Fruit" label violates Wisconsin's Deceptive Trade Practices Act and claims that J.M. Smucker Co. of Orrville, Ohio, was unjustly enriched because it knew of the actual ingredients but sold the product at an inflated price.
Brenda Dempsey, a spokeswoman for Smucker's, was not in her office Friday morning and did not immediately return a call from The Associated Press seeking comment on the suit.
Consumers have paid a premium price for the product, more per ounce than that paid for Smucker's fruit preserves, which must contain at least 47 percent actual fruit under federal law, the lawsuit contends.

 Patently Phony Americans
In a landmark ruling this week on a truly ludicrous appeal, a U.S. court rejected an effort by the American food company, JM Smucker, to patent a process by which it makes peanut butter and jelly sandwiches, that staple of American lunchboxes.
Fortunately, the court had no appetite for the appeal, even as John Montagu, the 4th Earl of Sandwich, who in 1762 asked for meat to be served between slices of bread to avoid interrupting a gambling game (thus inventing the sandwich), must have gagged in his grave.
Smucker argued that the way it sealed the P-B-J into a crustless sandwich was unique.

Patenting the Peanut Butter Sandwich » Thinkcorps
If the sandwich has already been patented by Kretchman (which Smucker’s admits, to my reading), then all Smucker’s is trying to do is procure an essentially defensive patent that would allow it to continue to innovate by producing its Uncrustables sandwiches without the fear of reprisals from Kretchman (or whoever currently owns its patents).
Having just now read (some of) the application, the real story is not that Smucker’s is trying to patent the sealed crustless freezable peanut-butter and jelly sandwich — because they aren’t.
They are trying to patent the sealed crustless freezable peanut-butter and jelly sandwich WITH protein-fortified nut butter, the preceeding invention having already been patented by Kretchman in patent 6,004,596.
