Lord Lloyd christened this mechanism an "overlapping warrant" – by which he meant an ordinary (non-certificated) warrant, which names the addresses or premises targeted for interception, and allows the interception of any communications (internal or external) from those addresses.
Lord Bassam's reply says that overlapping warrants are to continue, because "there will be cases in which a warrant complying with clause 8(1) cannot be put into effect in any other way; for example, when a person in the UK chooses, perhaps in an attempt to avoid interception, to use a foreign ISP".
However it is important to understand the extent and scope of the ways in which overlapping warrant have been in practice used for trawling-surveillance of internal communications, because the acceptance of 15(3) would create statute-law which broadens the allowable purposes beyond anti-terrorism.

Although noble Lords accepted that it was never our intention to include content within the definition of communications data, their misgivings struck a chord, and I agreed to reflect further on the wording of our amendment to see whether we could provide a stricter formulation that would assuage the concerns that had been understandably expressed.
My Lords, I welcome the fact that the noble Lord, Lord Bassam, and his department have taken so constructively the decision of this House when this matter was put to a vote on Report.
When the noble Lord, Lord Phillips of Sudbury, moved a similar amendment on Report, he wondered whether someone served with a disclosure notice who was not in possession of the relevant protected information at that time could be penalised unjustly under the Part III powers.

The noble and learned Lord the Lord Chancellor advanced recently the crazy argument that the more legitimate this House is made the more it can command the respect of and reflect the views of the people, and the fewer powers it should have.
My Lords, if the remit of this proposed committee is only to codify existing conventions and not to change them, and if, as the noble Lord, Lord Cope, has indicated, codifying some of them would be nearly impossible, it seems to me that this committee will be a complete waste of time and money.
My Lords, I suggest to the noble Baroness the Leader of the House that experience might have recommended to her and her colleagues a somewhat different way of approaching what is clearly a sensitive and important matter of constitutional reform.

A government bill was wrecked last night when the Lords voted by 222 to 126 to keep defendants' right to choose trial by jury.
The Conservative home affairs spokesman, Lord Cope of Berkeley, opening the debate, argued that the partly reformed House of Lords, comprising appointed peers and elected hereditaries, had the authority to vote down the bill.
Lord Cope, a life peer and former MP, added: "Perhaps in due course there will be a different second chamber in the United Kingdom.

Lord Avebury pointed out that if they did come from the People’s Republic they might have valid claims to asylum and that the production in those circumstances of false travel documents was not a criminal offence.
The Conservative Lord Cope agreed in principle with the main objections from Lord Lester and Lord Avebury.
Lord Bassam, in replying, made two points: first that the exemption simply allowed "existing legislation to continue as Parliament, in our view intended"; secondly that it provided the immigration authorities "with the necessary latitude to conduct their business rationally".

I shall not pursue the point now, but I hope that the noble and learned Lord who is to reply will confirm that the Government will not use the Parliament Act in relation to this measure.
It is because of the necessity to examine the facts that we are all grateful to the noble Lord, Lord Burns, to my noble friend Lord Soulsby and to their colleagues for their report on the practical aspects of hunting.

Lord Cope of Berkeley, a former treasury minister turned director of Prove It 2000, has been pushing for the move since the end of January.
In a letter to Lord Cope, the Treasury said the Inland Revenue would end the uncertainty surrounding this issue and publish full guidance on the taxation of millennium work at the end of April.
The rule change should encourage companies to get on with Year 2000 work, but the uncertainty is far from over, according to Robin Guenier, executive director of Taskforce 2000, a lobbying organisation funded by the private sector.

 UN Convention less effective in UK than other states | Medical Foundation for the Care of Victims of Torture
When the Law Lords ruled that the cases of torture that could be heard against General Pinochet should be limited to those that took place after December 1988, when torture became a crime under UK law, the Medical Foundation ensured there were affidavits from torture survivors who fulfilled that criterion.
In response in particular to my noble friend the Lord Sheppard, officials are due to review both the instructions and the written reasons for detention early in the new year and I hope that if possible the form will be amended to include any information known which supports a history of torture.
Similar comments were made in the debates on report in the House of Lords and to Lord Falconer's letter to the Lord Cope of Berkeley on 28 October 1999.

The much abused RIP Bill received yet another beating yesterday, as the House of Lords committee discussed what Lord Cope of Berkeley called “a major rewrite”.
Lord McNally said: “We are almost now dealing with a House of Lords Bill, so dramatically is the Bill being rewritten as we proceed.” Lord Strathclyde, opposition peers' leader, had earlier dubbed the Bill a "bungled and shambolic snoopers' charter."
Lord McNally also commented on what he said was the lack of governmental research and planning: “I hope that in future, outside expertise will be brought in at an early stage, rather than being brought to bear on the Home Office before concessions are made, as in this case.”
