The Aboriginal Fisheries and the Sparrow Decision (BP341e)   (Site not responding. Last check: 2007-11-05)
Sparrow did not dispute the facts; on the contrary, he argued in his defence that he was exercising an existing aboriginal fishing right; that is, a constitutional right protected under section 35(1) of the supreme law of the country.
It accepted the fact that Sparrow had an existing aboriginal right, but noted that certain constitutional issues should be referred back to the court of first instance, and established criteria that the trial-level judge should take into account.
Because of this limitation, the band had experienced financial difficulties: the rate of unemployment and the degree of poverty had increased for both individuals and the community.

John Kay (musician) - Wikipedia, the free encyclopedia
His family escaped from East Germany in 1948 (as recounted in his song "Renegade" on the album Steppenwolf Seven), resettling in Hanover, West Germany, before moving to Canada in 1958.
He joined a blues rock group known as The Sparrow in 1965, which had moderate success in Canada before augmenting its line-up and changing its name to Steppenwolf in 1967, which had international success with songs such as "Born to Be Wild", "Magic Carpet Ride", "Monster", and "Rock Me".
He recorded both as a solo artist and with Steppenwolf during the late 1970s and is still touring with a new Steppenwolf line-up in 2004.

By adhering so closely to the past the band accepts a risky proposition: Sparrow could be a triumphant display of the benefits of scouring the musical archives, or it could be a hollow re-enactment.
Of course, a band does not have to renew the conventions of a previous genre, merge them with the present state of music and make them relevant once again in order to make a good album.
But Sparrow merely nods to bands like the Left Banke that purists will argue have already done this sort of thing before, and done it better, and it lacks the catchiness and sheer force of will to make fans of more low-fidelity indie pop pay any attention at all.

 Canada, R. v. Sparrow
Appellant was charged in 1984 under the Fisheries Act with fishing with a drift net longer than that permitted by the terms of his Band's Indian food fishing licence.
He admitted that the facts alleged constitute the offence, but defended the charge on the basis that he was exercising an existing aboriginal right to fish and that the net length restriction contained in the Band's licence was invalid in that it was inconsistent with s.
These include: whether there has (page 1080) been as little infringement as possible in order to effect the desired result; whether, in a situation of expropriation, fair compensation is available; and whether the aboriginal group in question has been consulted with respect to the conservation measures being implemented.

 Biography
In the chaotic world of rock 'n' roll, in which the lifespan of most bands can be measured in terms of a few years or a few months, John Kay and Steppenwolf have emerged as one of rock's most enduring and respected bands, delivering hard-hitting, personally-charged music for more than three decades.
And, in addition to being the first band to use the term "heavy metal" in a song (in "Born to Be Wild"), Steppenwolf's punchy style helped to establish the fundamentals of the hard-rock sound that would flourish in the 1970s.
Steppenwolf soon emerged as one of the few bands of the late '60s to successfully straddle the pop-oriented AM mainstream and the hip FM underground, scoring substantial success on both the single and album charts without tailoring its approach to pander to either constituency.

Sparrow's self-titled debut is the new project from ex-Zumpano drummer Jason Zumpano, and that's about the most exciting thing I can say about it.
There's a possibility that it once did-- Sparrow was originally conceived, just after the breakup of Zumpano's band in the late 90s, as an instrumental affair.
Maybe it's that, amidst the colorless piano tones of Sparrow, the casual strum of an acoustic guitar can sound like a revelation, or that for the first time on the whole record, Zumpano's disenchanted vocal style seems to fit better with the generally apathetic lyrics of the song.

They also recruited two band mates from outside of The Sparrow, one of whom was very young but had developed a reputation as an excellent guitar player, Michael Monarch, and bass player Rushton Moreve.
