Theodore Davie moved in appeal against the judgment of the Chief Justice rendered in favor of the defendants on the 11th July last.
Davie would have to address himself to would be the power of the judges to sit as a court at all, inasmuch as the Supreme Court Amendment Act, 1881, sec.
Davie proceeded to argue that the sections in question were unconstitutional and void upon the general ground that they assumed to take the decision of the rights of suitors from the judiciary and to place the same in the hands of the local government, a body liable to be swayed by policy or prejudice.

Theodore Davie, introduced an Act modelled on the Ontario Public Health Act which was very much more comprehensive and complete.
Davie was then appointed as Provincial Health Officer, and acting under the regulations that were quickly drawn up and proclaimed under authority of the Act, he was able to effectually check the spread of the epidemic.
Of course, under the authority of the Municipal Act, Municipal Councils were empowered to legislate on health matters, but action taken by virtue of such authority was necessarily restricted in scope and lacked unanimity when uniformity and concertness were required.

After his brother was elected premier in 1887, Davie served as de-facto attorney general, and as his brother grew increasingly ill he effectively ran the province from behind the scenes.
Davis was never a supporter of the more extreme antislavery wing of the Republican Party, and he angered much of the party with his majority opinion in the Ex parte Milligan case of 1866.
Chester A. Arthur became president, Davis was elected president pro tem of the Senate, which made him virtually acting vice president of the United States, and he held this position until the expiration of his term in 1883.

Davie was the author of Common Law and Statutory Amendment in Relation to Contributory Negligence in Canada, as well as a prolific contributor to the Canadian Bar Review.
Davie's connection with the league did not last long: he allowed the CACL (Canadian Branch) to be part of the merger which led to the formation of the Correspondence Chess League of America in 1917.

After their departure in December 1882, Beaven faced the house and, despite his minority position, proceeded to present his legislative program. The farce ended when William Smithe* moved a confidence vote: the government was defeated 16 to 8 and Beaven resigned on 29 Jan. 1883.
      During the next 11 years as leader of the opposition to the administration of Smithe and his successors — Alexander Edmund Batson Davie*, John Robson, and Theodore Davie* — Beaven saw resolved many of the issues that had taken so much of his time, not always to his satisfaction.
The graving dock was turned over to the federal government to complete but the federal Settlement Act of 1884 transformed the proposed island railway into a separate company unconnected with the transcontinental line.
