The theory of conduct is "the study of right and wrong, of obligation and permissions, of duty, of what is above and beyond the call of duty, and of what is so wrong as to be evil." But matters can be simplified considerably.
A theory is a deontological theory of conduct iff it says that what we ought to do is governed by rules stating what our duties are, regardless of the consequences of our actions are.
So if, in formulating the deontological theory of conduct, we wind stating a rule, then by god, we'd better be prepared to give an argument that we should all follow that rule.

The Court articulated an originalist test: courts may recognize such claims so long as they allege violation of norms analogous to the law-of-nations norms against piracy, the violation of safe conducts, and the violation of ambassadorial rights prevailing in 1789 when the ATS was enacted.
The safe conduct was a sovereign-to-sovereign promise of safety to aliens within a sovereign's territory or in areas controlled by a sovereign's troops, and thus not limited by the nationality of the tortfeasor.
The tort was a broad and ancient one: broad because any plain-vanilla tort if committed against a foreigner could count as a violation of applicable law of nations or treaty; venerable because it originated with Magna Carta as an English sovereign means to encourage interstate commerce at a time of limited cross-border travel.
