Torrens title - Wikipedia, the free encyclopedia
Torrens title is a system of land title where a register of land holdings maintained by the state guarantees indefeasible title to those included in the register.
Torrens himself acknowledged adapting his proposals from earlier systems of transfer and registration, particularly the system of registration of merchant ships in the United Kingdom.
The Torrens system was also a marked departure from the common law of real property and its further development has been characterised by the reluctance of common law judges to accept it.

Torrens led the Anti-Bullionists during the Bullionist Debate of the 1810s but later did a virtual 180° turn to join the side of the Currency School in the Banking-Currency School Debate of the 1840s.
Torrens was an independent discoverer of the Ricardo's principle of "comparative advantage" in international trade (albeit a promoter of "reciprocal tariffs", rather than unilateral free trade).
Torrens was also a co-discoverer of the Ricardian theory of "differential rent", although, in later editions, recanted the Malthusian population doctrine on which it was partly based.

Its reproduction, in Torrens' view, was justifiable because the 1842 crisis which inspired it, reproduced all the causes of the 1830 crisis.

Specifically, the claimants contended that they were readily ascertainable parties due personal notice of the Torrens proceedings, because their interests were recorded in the Costilla County records, were referenced in both Taylor's deed and the Gilpin agreement, were mentioned in the title examiner's report, and were referred to in Taylor's own application.

Arguably this omission to take account of unregistered interests (though conversely, one suspects that Torrens would not have regarded it as an omission, given that he considered that unregistered interests were only to operate between the parties) has led to the obscuring of some of the important and critical policy objectives of the system.
[18] In a contemporary environment, where the importance and significance of equity jurisprudence is not to be underestimated, the Torrens system has had to adapt to the complexity of interests that attach to modern land holdings and to provide some form of mechanism for their recognition and protection.
However, in respect of land to which the [Torrens legislation] applies, registration of a transfer is not fraudulent in the statutory sense required to qualify the operation of the doctrine of indefeasibility, merely because the transferee knows that registration will defeat an antecedent unregistered interest of which the transferee has notice.
