The suit accuses Marana of a raft of procedural violations in approving a controversial 1,260-acre annexation in the heart of the ironwood forest country near the Tortolita Mountain foothills.
Tortolita this week, the board agreed that the 1,260 acres wouldn't go into Tortolita, assuming that the Marana annexation was lawful and wasn't overturned by referendum.
Tortolita's suit charged that the Marana council improperly adopted the annexation without holding a hearing and without proper notice.

A three-judge panel of the appellate court based in San Francisco upheld a 1961 Arizona statute requiring a community of 1,500 or more to obtain the consent of all existing municipalities of more than 5,000 residents within six miles before it can incorporate.
A Superior Court judge upheld its constitutionality, and the county supervisors declared the town incorporated.
But the Arizona Court of Appeals reversed that ruling, calling the 1997 statute an unconstitutional special and local law and voiding the incorporation.
