Although Tower's counsel asked Dempsey whether he and his firm participated in the survey evaluations of Tower, Kaminsky sustained Committee counsel's objection to this line of questioning on the ground that, "in order to maintain its integrity," the survey was anonymous.
Tower further asserts that the Committee made it impossible for Tower to confront and cross-examine witnesses by refusing to allow Tower to examine the questionnaires to determine whether comments read by Kaminsky into the record were accurate, representative, or from multiple sources.
Tower implicitly argues that, even if survey anonymity is permissible, it should have been allowed to inspect the questionnaires, as the identity of a survey respondent is not disclosed on the questionnaire form.
