Topic: Trackage rights

Arrangements between railroads - Wikipedia, the free encyclopedia
Trackage rights or running rights is an arrangement where the company that owns the line retains all rights, but allows another company to operate over certain sections of its track.
Temporary rights agreements are typically made when some kind of disaster affects one railroad while a parallel railroad line is fully operational.
A union station typically involves trackage rights; the company that owns the station and associated trackage is typically owned in part by the railroads that use it, which operate over it by trackage rights.

The unions state that the trackage rights MP granted Conrail are not intended to permit Conrail to go from a point on one of its lines to a point on another of its lines.
The railroads argue that the subject trackage rights operation is within the class of transactions exempted in Procedures and is a bona fide transaction undertaken to provide improved service to shippers and to achieve operational efficiencies and economies which otherwise could not be accomplished in the absence of the operation.
Regarding TCW's trackage rights, CPR shall not consummate the abandonment until TCW obtains discontinuance authority or an exemption and interested persons are given an opportunity to seek imposition of trail use and public use conditions.

Approval of the consolidation was conditioned on the grant of the trackage rights by the consolidating carriers.
Finally, he observed that "the Commission's goal of preservation of competition through the grant of trackage rights might well be frustrated by the prospect of requiring the railroads granted those rights to negotiate with the union representing the employees of its competitors" (id. at 39a (emphasis in original)).
As Judge MacKinnon explained, "the Commission's goal of preservation of competition through the grant of trackage rights might well be frustrated by the prospect of requiring the railroads granted those rights to negotiate with the union representing the employees of (their) competitors" (id. at 39a (emphasis in original)).

Once the agency approves trackage rights (whether through an individual exemption, a class exemption, or the application process), those rights remain in effect until it is specifically determined that their discontinuance is consistent with the public interest.
CN's acquisition of rights over VBBC track in Canada (between the border and the junction with CN at St. Leonard) was not subject to the Board's jurisdiction.
Section 10101(9), although not directly implicated in the class exemption for trackage rights, favors policies that encourage the "honest and efficient management of railroads." The statement of CN officer Clifford L. Carson rebuts any inference that CN acted other than honestly and efficiently in pursuing the exemptions.

According to petitioners, the trackage rights arrangement exempted in STB Finance Docket No. 33926 is necessary because BNSF will be performing maintenance and repairs on its main line and will utilize the trackage rights over UP's lines as alternate routes for BNSF's traffic during that time.
Petitioners further maintain that, without approval of temporary trackage rights, it is unlikely that any other arrangement can be reached to allow BNSF to operate over UP's line, and BNSF would face the possibility of severe congestion and service disruption on its main line.
Limiting the term of the trackage rights is consistent with the limited scope of the transaction previously exempted and will have no adverse impact on shippers on the line as the trackage rights that are the subject of the exemption are for overhead traffic only.

In addition, CSXT is granting trackage rights to CPR over the Detroit Subdivision, from milepost CH 7.5 +/- to milepost 13.5 +/-, along with trackage at Oak Intermodal Facility necessary to effect the delivery of trains, including necessary head and tail room, for a total of approximately 6.3 +/- miles.

Finally, the court found its construction of the statute confirmed by the constitutional questions it thought would be raised if Amtrak were empowered to condemn private property to transfer it to another private owner, and the absence of a clear statement from Congress that it intended to permit that result.
As Judge Ginsburg recognized in her concurring opinion, the ICC correctly found that no impairment of B&M's common carrier functions is threatened here because Amtrak was required to pay compensation for the line, and B&M was offered trackage rights to serve its existing local customers.
The majority, however, insisted that post-conveyance remedies are entirely irrelevant to the issue of impairment; instead, the majority claimed that the evaluation of impairment must be restricted to the effects of the condemnation viewed in isolation.

In doing so, we hold that the bankruptcy court does not have the authority under section 1170 to adversely abandon the lines or trackage rights of a non-debtor, on the petition of a debtor railroad who owned those lines at the time of bankruptcy.
The STB found that the trackage rights obligation between CN and BAR (and now honored by MMandA) in March 2001 was fair and entered into at arm's length.
He proposes allowing the bankruptcy court authority over abandonments of a non-debtor's rail lines and trackage rights in situations in which the debtor has a property or contract interest in the non-debtor's lines or trackage rights.

 National R.R. Passenger Corp. v. Boston & Me. Corp., 503 U.S. 407 (1992).
B&M next sought to convert the proceeding into a trackage rights proceeding under § 562(a), but the ICC again rejected B&M's position, holding that Amtrak had an "election of remedies" under § 562 and so had no obligation to seek trackage rights under subsection (a) before invoking subsection (d).
As Amtrak could obtain use of the property by obtaining either a trackage rights agreement under § 562(a), or by condemning an easement under § 562(d), the entire fee interest was not " `required for intercity rail passenger service.' " 286 U. App.
The ICC was not unreasonable in considering the effect of the trackage rights agreements and the just compensation award in assessing significant impairment; and the ICC's conclusion, that B&M's ability to carry out its common carrier obligations will not be impaired by the transaction in any significant way, is supported by substantial evidence.

W&LE, a regional railroad that had been created in 1990 as an NS spin-off and that had thereafter expanded with line acquisitions and trackage rights grants from CSX, NS, and Conrail, was concerned that it would be severely affected by the Conrail Transaction as proposed.
In addition, NS and W&LE treated the Huron Dock lease and associated trackage rights as de facto extended, pending negotiation of a settlement to implement the Huron Dock condition.
These trackage rights are intended to be used in combination with rights for W&LE to operate over NS’s lines between the Knob and Campbell Road Yard, and over CSX’s lines between Wellington and Berea.
