Lately a number of western authors and commentators referred to the Treaty of Huydaybiyya
The treaty was established in the year 628 between the Prophet Muhammad and the Quraysh tribe, rulers of his birthplace Makkah, several years after the Prophet had migrated to the city of Madina to avoid the Quraysh’s vicious persecution of the Muslim faithful.
According to the terms, the Arab tribes of the Peninsula were free to choose their allegiance; either to ally themselves with the idolaters or with the Prophet.
It was only after this clear and forthright upholding of the conditions of a treaty whose conditions were utterly humiliating for the Muslims, and only after giving the Quraysh every chance to make amends, that preparation for the retaking of Makkah by the Prophet took place.

Quraish in the light of the articles of the treaty, had indirectly relinquished its claim to religious leadership, and admitted that they were no longer interested in people other than Quraish, and washed their hands of any sort of intervention in the religious future of the Arabian Peninsula.
The article of the treaty pertaining to cessation of hostilities for ten years points directly to the utter failure of political haughtiness exercised by Quraish and its allies, and functions as evidence of the collapse and impotence of the war instigator.
However, two points in the treaty made it distasteful to some Muslims, namely they were not given access to the Holy Sanctuary that year, and the seemingly humiliating attitude as regards reconciliation with the pagans of Quraish.

The treaty of Hudaybiyyah was temporary since it was a treaty between idol-worshippers and Muslims, and cleaning Arabia from idolatry was a basic duty of Islam.
In this Treaty, the Prophet accepts all demands of the Quraish in return for a ten-year truce.

Indications of Essential Bad Faith; Arafat creates a rationale for non-compliance
Of special interest, in this context, are Arafat's repeated references to the Treaty of Hudaybiyyah, signed by the Prophet Muhammad with his Meccan enemies when they were still stronger than him, and then abandoned (as he conquered the city) within a much shorter time than the Treaty itself warranted.
What Hudaybiyyah means for him was made even clearer when he spoke, a few months later, on the occasion of the anniversary of the fire in al-Aqsa (an event, in 1968, caused by an Australian madman, but often used in Palestinian propaganda as proof of Israel's evil intentions).
The reference to the Hudaybiyyah treaty re-surfaced in 1998, coupled with the warning that "all the options are open to the Palestinian people".

The Prophet (saws) compromised a lot for the treaty to come through: not out of weakness but out of the desire to spread his mission through peaceful means supported by evidences.
After Abu Bakr had left this chapter was revealed breaking the treaty between the Prophet (saws) and the pagans with the effect that no one intending the House thereafter could be prevented nor anyone threatened during the pilgrimage season.
By relating the honoring of the treaties to piety, Allah (swt) tells us by implication that being true to a treaty is not simply a good Islamic principle, nor should it be attempted because it promises to be beneficial.

Furthermore, the denial of entry to the pilgrims was a clear violation of Quraysh’s traditional role as host of the pilgrimage, just as Quraysh’s leadership in battle and position as head of tribal alliances had been destroyed by their inability to defeat the Muslims.
By the time they broke the treaty, a mere show of force with the assembly of 10,000 troops outside Makkah was enough to overcome the city with only token opposition.

The treaty of Hudaybiyyah gave an option to everyone to enter into alliance with the Prophet of God (Sallallahu 'Alaihi Wa Sallam) and arrive at a similar agreement with the Quraysh.
He swore that the Quraysh had annulled the treaty with the Prophet (Sallallahu 'Alaihi Wa Sallam) by attacking his allies when they were at their well and had not spared their lives even when they were performing prayers.
The terms were relayed to the Quraysh but in the fit of their pride they replied, “Yes, we would prefer measure for measure.” The Muslims were thus absolved of their undertaking with the Quraysh and it became incumbent upon them to exact justice for the wrong done to their allies.

The thinking behind this idea is that such a treaty will motivate the Palestinian Arabs by giving them something to reach for—a trophy to be won once they’ve become a peace-loving people—at which point it will be brought down off the shelf and handed to them.
There is always the danger that someone rummaging through treaties in the back rooms of the State Department or Knesset or a Bedouin tent will stumble upon the non-implementation treaty and mistake it for the other kind and try to implement it.
Take for example the intention behind the Arab concept of hudna, or “truce,” the most famous of which was the Treaty of Hudaybiyyah between Muhammed and the Quraysh tribe, in which the former slaughtered the latter two years after it was signed.
