The Appeal Division had jurisdiction to hear appeals of decisions of the Trial Division, as well as to determine applications for judicial review of decisions made by specific boards and tribunals, set out in section 28 of the Federal Court Act.
Decisions of the Trial Division could be appealed to the Appeal Division, and further appealed from the Appeal Division to the Supreme Court of Canada, after receiving leave, or permission, from the Supreme Court.

All matters scheduled for trial which do not commence on the first day of the Court week are subject to call later in the week and counsel shall have all parties and witnesses available to commence trial for the entire week (or weeks in the event of a two week trial docket).
In the case of the latter, and the trial date must be continued to facilitate the evidentiary pre-trial motion, the defendant shall be personally notified of the evidentiary pre-trial motion date and a new trial date, at the pre-trial.

(a) The trial division of the Supreme Court has original and exclusive jurisdiction in cases affecting officials of foreign governments, disputes between states, admiralty or maritime cases, and in cases in which the national government is a party except where an interest in land is at issue.
The appellate division of the Supreme Court of the FSM may accept direct filing of a case and an expedited briefing schedule may be established where there is limited time available and prompt resolution of the issues in the case is decidedly in the nat.
Normally the trial court fashions the remedies and sanctions for failure of a party to comply with discovery requirements and the exercise of the trial court's discretion should not be disturbed by an appellate court absent a showing that the trial court's action has unfairly resulted in substantial hardship and prejudice to a party.

All prosecutions for crimes or offenses shall be had within the division of such districts where the same were committed, unless the court, or the judge thereof, upon the application of the defendant, shall order the cause to be transferred for prosecution to another division of the district.
It is the policy of the United States that all litigants in Federal courts entitled to trial by jury shall have the right to grand and petit juries selected at random from a fair cross section of the community in the district or division wherein the court convenes.
The amendment eliminates the requirement that the prosecution shall be in a division in which the offense was committed and vests discretion in the court to fix the place of trial at any place within the district with due regard to the convenience of the defendant and his witnesses.

By order entered 31 December 1992, the trial court (1) set aside the jury verdict and judgment entered thereon as to the decedent's contributory negligence, (2) entered judgment for the plaintiff upon the issue of contributory negligence, and (3) ordered a new trial on the issue of damages.
From this order defendants appealed to the Court of Appeals, contending that the trial court erred as a matter of law in granting plaintiff's motion for judgment notwithstanding the verdict and motion for new trial on the issue of damages and in allowing plaintiff to put on rebuttal evidence regarding decedent's contributory negligence.
The trial court accepted the verdict on the first two issues, but set aside the verdict on the issue of damages and granted plaintiff's motion for a new trial limited to that issue.

In 2001 and 2002 Expert Division robots were required to operate within the standard arena using all of the deductions (audio start, arbitrary start, furniture, etc.) In 2003 the contest added a new challenge, a two-story arena whose configuration changed from run to run.
Division entry fees will not be refunded after registration so if you choose to change divisions after registration you will need to re-register your robot in the correct division.
The division structure was created to make the event more fun for students, but at the same time we realize that we are opening another entire area of possible conflict and problems.
