 Roth v
Turbomeca further asserts, however, that the circuit court properly dismissed the Roths' lawsuit because they alleged a mere conclusion--that they were helpless and unable to set aside the settlement once the annuities had been funded--and did not allege facts in support of the conclusion.
Turbomeca argues that, had the Roths informed the circuit court of the alleged misrepresentation rather than dismissing their lawsuit, the circuit court could have employed appropriate sanctions pursuant to Rule 61.01 and could have allowed the Roths to take their underlying tort claims to trial.
Thus, Turbomeca made the representations, and the circuit court properly refused to impute the representations to the attorneys.

A party suing for fraud in the inducement of a release is not suing for the [*18] tortious conduct underlying the released claims, but for the contractual damages that he suffered as a result of the subsequent fraud foisted upon him.
Turbomeca further asserts, however, that the circuit court properly dismissed the Roths' lawsuit because they alleged a mere conclusion--that they were helpless and unable to set aside the settlement once the annuities had been funded--and did not allege [*19] facts in support of the conclusion.
Unlike the plaintiffs in Phipps and Hatch, the Roths are not suing because they endured the inconvenience or aggravation of a discovery violation, but because that violation resulted in their executing a settlement agreement that they would not have executed had they known the truth.
