Topic: Type 99 cannon

FindLaw for Legal Professionals - Case Law, Federal and State Resources, Forms, and Code
Cannon's primary contention on appeal is that he was denied a full and fair opportunity to litigate this claim because the state trial court did not make specific, express findings that Cannon actually consented to the search or that any such consent was voluntary.
Cannon argued that these documents were material and exculpatory and that the prosecution's failure to disclose the documents prevented him from adequately litigating his illegal-arrest and warrantless-search claims.
Cannon argued in his habeas petition before the district court and reasserts on appeal that he was denied his Sixth Amendment right to effective assistance of counsel when his trial counsel failed to develop and introduce additional mitigation evidence during the penalty phase of the trial.

 99-6311 -- Cannon v. Gibson -- 08/07/2001   (Site not responding. Last check: 2007-10-08)
Cannon's convictions on these same charges following a first trial were reversed by the OCCA on the ground that the trial court should have severed Cannon's trial from that of his co-defendant.
In the alternative, Cannon asserts that his trial counsel provided ineffective assistance in failing to obtain the relevant materials prior to trial and that counsel's ineffective assistance denied him a full and fair opportunity to litigate his illegal-arrest claim.
Because Cannon never raised this claim in state court, either on direct appeal or in a petition for post-conviction relief, the claim is technically unexhausted.

 Mitsubishi JM2 Raiden - 'Jack'
The prototype Mitsubishi M-20, powered by a 1,460 hp Kasei, gave a great deal of trouble, with the result that the aircraft was largely redesigned as the J2M2, with a different engine, much deeper canopy, multi-stack exhaust and a new four-blade propeller.
Even then the Raiden suffered repeated faults and several crashes, but eventually 155 of the J2M2 were delivered with two 20mm Type 99 cannon and two 7.7mm machine-guns.
This variant only carried two 20mm cannon (in the wings) but was powered by a far better engine, and it proved formidable against raiding B-29s.

The Type 98 (and other improved and evolving armored vehicles like it) represent a potentially significant and continuing heavy threat confronting U.S. Army forces in the future.
Perhaps the most interesting characteristic of the Type 98 is the addition of what appears to be a previously unknown active self-defense system.
