A unanimous Court found the law not preempted, holding that regulation of the underlying industry of which the employers were members does not require preemption.
The Court was persuaded that the tax was not the type of state law that Congress intended ERISA to preempt.
As the district court noted, it appears that the legislature was concerned both with the quality of care and with denials of care.

The 94 U.S. judicial districts are organized into 12 regional circuits, each of which has a United States court of appeals.
A court of appeals hears appeals from the district courts located within its circuit, as well as appeals from decisions of federal administrative agencies.
In addition, the Court of Appeals for the Federal Circuit has nationwide jurisdiction to hear appeals in specialized cases, such as those involving patent laws and cases decided by the Court of International Trade and the Court of Federal Claims.

Last December, a three-judge panel of the 9th U.S. Circuit Court of Appeals ruled a Texas probate court's decision should stand: the son was the oilman's sole heir — and doesn't owe Smith anything.
"The 9th Circuit's ruling is not based on the merits of the case, but instead on what we believe is a misapplication of a jurisdictional exception regarding probate cases," he said.

INS's denial of the application in February 1997 triggered a series of declined appeals and motions, including an appeal to the Board of Immigration Appeals in March; an INS application for adjustment in June 1999; and a second visa petition to the INS, accompanied by a continuance request to an immigration judge.
The IIRIRA provides that no court has jurisdiction to review 'any decision or action of the Attorney General the authority for which is specified under this subchapter to be in the discretion of the Attorney General,' except for granting relief under 8 U.S.C. [Section] 1158(a) (2004), Murphy wrote.
