After the election, a version of the Homeland Security bill was reported out by the conference committee, with several special-interest goodies, including the thimerosal language, that hadn't been in either the House bill or the Senate bill.
That provision appeared in neither the House nor the Senate version of the Homeland Security bill as passed before the election, since it has nothing to do with homeland security.
Glenn Reynolds was good enough to post a note I sent him reviewing the legislative history of the thimerosal caper, along with some of his own reflections.

 Poland -> History on Encyclopedia.com 2002
In 1505 the gentry forced King Alexander (reigned 1501-6) to recognize the legislative power of the Sejm, or diet, which comprised a senate (made up of representatives of the landed magnates and of the high clergy) and a chamber (consisting of the deputies of the nobility and of the gentry).
In practice, this meant that internal factional rivalry prevented the establishment of any great Polish dynasty; contested elections and insurrections by the gentry were frequent.
After the death (1572) of Sigismund II, last of the Jagiellos, the theory that the entire nobility could take part in the royal elections was newly guaranteed.
