USTR said that the case was part of Canada's broader strategy of contesting U.S. antidumping and countervailing duty orders on softwood lumber.
USTR has asserted that Canadian softwood lumber sold in the U.S. market is directly and indirectly subsidized by provincial governments through a complex web of below-market-rate pricing, long-term timber harvesting contracts and mandated operation requirements.
In other words, imports made prior to the time that the USTR directs the Commerce Department to modify or revoke the order would not be subject to the new determination.

The lawsuit, filed Wednesday by Earthjustice on behalf of the Center for International Environmental Law, seeks to force the USTR to disclose written proposals it has made to other governments concerning provisions of the FTAA agreement, a treaty that would bind the United States to powerful new trade rules.
"USTR is negotiating binding rules that could affect the ability of the United States to protect the environment and human health," said Stephen Porter, Senior Attorney with CIEL.

According to the USTR, an FTA with SACU, already the US' largest sub- Saharan African export market, would likely enhance both US political and economic links to the African region and lead to spurred development.
