Subsequent mineral owners, such as the heirs of the original mineral owner, may be unconcerned about an apparently valueless mineral interest and may not even be aware of it; hence their interests may not appear of record.
A mineral interest is dormant for the purpose of this [Act] if the interest is unused within the meaning of subsection (b) for a period of 20 or more years next preceding commencement of the action and has not been preserved pursuant to Section 5.
The reference is not effective to preserve a particular mineral interest unless there is, in the county, in the name of the person claiming to be the owner of the interest, (i) a previously recorded instrument that creates, reserves, or otherwise evidences that interest or (ii) a judgment or decree that confirms that interest.

A mineral interest is dormant for the purpose of this article if the interest is unused within the meaning of subsection (b) of this section for a period of twenty or more years next preceding commencement of the action and has not been preserved pursuant to section 38‑42.5‑105.
A mineral interest is not dormant if the notice is recorded within twenty years next preceding commencement of the action to terminate the mineral interest or pursuant to section 38‑42.5‑106 after commencement of the action.
This act shall take effect July 1, 2003, unless a referendum petition is filed during the ninety‑day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution.

UECA left the creation of environmental covenant registries as an optional part of the Act; the decision to create a registry is left completely to the discretion of the state.

 AN ACT UPDATING AND REVISING THE CONNECTICUT UNIFORM SECURITIES ACT.
The commissioner may not institute a suspension or revocation proceeding on the basis of a fact or transaction known to the commissioner when the registration became effective unless the proceeding is instituted within one hundred eighty days of the effective date of such registration.
Upon the entry of a summary order, the commissioner shall promptly notify all interested parties that it has been entered and of the reasons therefor and that within fifteen days of the receipt of a written request the matter will be set down for hearing.

The priority of recorded interests is governed by other law, including law relating to the police powers of the State and public policies protecting health and the environment, and is unaffected by this Act, except as provided in section 3009, subsection 3 for tax liens.
If an interest in real property is subject to an environmental covenant, the interest is not affected by an amendment of the covenant unless the current owner of the interest consents to the amendment or has waived in a signed record the right to consent to amendments.
Except for an assignment undertaken pursuant to a governmental reorganization, assignment of an environmental covenant to a new holder is an amendment.

ADVERSE POSSESSION; CONSTRUCTIVE POSSESSION; MINERAL RIGHTS: Despite possession of the surface estate for property for the statutory period with color of title to both the surface and mineral estates, plaintiff had not adversely possessed the mineral estate when the mineral and surface estates of such property had been severed.
The court held that in order to possess a severed mineral estate adversely against the owner, one must take actual physical possession of the minerals under the surface or so exclude the owner that he or she cannot enter upon the land to drill.
But, since the mineral estate was an entirely separate estate, adverse possession of the surface property was not "possession" of the mineral estate at all, even such possession sufficient to trigger a constructive possession claim.

This is the interest of the state to be free from the restraint of intrusive federal control when attempting to meet the demands of its citizenry in the very real and necessarily pragmatic world of local government.
If the institutional interests of state governments in limiting federal intrusion into hitherto local spheres of concern are ordinarily taken into account in congressional actions, then the political process of federal legislation may be counted on to incorporate a consistent check against the full use of congressional power.
Although these cases have implicated both state and federal interests, that seems to be missing is a sufficient basis in the text of the Constitution, a workable doctrinal approach to line-drawing, or an egregious enough harm to a structural postulate of the Constitution to merit invalidation of a federal act.
