The team was variously informed that the programme consisted almost entirely of Bulgarian units (by University staff); that it was an approximately equal blend of University units and Bulgarian units (by UNWE staff); and that it was predominantly composed of University units (by the students who followed the programme).
The ‘ownership’of the programme by the University is underlined by the fact that it moderates the marking of assessed work by UNWE staff, and by its approval of external examiners, who operate and report under University protocols.

The case of Thorne v University of London 1966 [View] was applied, notwithstanding that Thorne was a case concerning the Visitor, since Thorne 'emphasises the primacy of the university authorities where proper machinery is provided for the regulation of issues between them and those making complaints about their performance of their university duties'.
The student's allegations were of bias and of a failure to comply with University regulations, yet in substance Buxton LJ considered the disagreement to be solely about purely academic matters.
The reason this relief was granted (HEI's decisions were quashed) was that the court decided that the student's claim was not, in fact, a challenge to pure academic judgement/expertise; rather, it was a challenge to the procedure adopted in reaching the decision to not allow the student to continue with her research.
