The university believed that the contact between the prospect and the athletics representative at a local high school and the North Gymnasium on the institution's campus was incidental to their participation in competitive pick-up basketball games and did not involve recruiting activity by the athletics representative.
Regarding the university's failure, as indicated in finding II-A, a representative of the university's athletics had numerous in-person contacts with the prospective student-athlete and his aunt and provided at least $4,000 to the prospect while he was still a prospective student-athlete and prior to the July 24, 1997, release from his National Letter of Intent.
The university self-reported that, during the years 1998 and 2000, the mother of a men's basketball student-athlete used the university's Federal Express account number to send five packages free of charge from her home to her son in Las Vegas; a total benefit of $145.99.

Locals told pollsters they would most like to see the museum chronicle "vintage Vegas," described as the architecture, music and figures that dominated the city's landscape from the 1930s to the 1950s.

This appeal by the University of Nevada, Las Vegas (hereinafter referred to as UNLV), requested the NCAA Division I Infractions Appeals Committee to overturn one of the penalties assessed by the NCAA Division I Committee on Infractions against the men's basketball program.
The Committee on Infractions found that UNLV was subject to the provisions of NCAA Bylaw 19.6.2.3 regarding repeat violators.
It was found that a student-athlete failed to deport himself with the generally recognized high standards normally associated with participation in intercollegiate athletics and violated the provisions of ethical conduct when he provided false information to the NCAA enforcement staff and the university on January 18, 2000.
