  Comment 014 - David E. Sorkin
Opponents of unsolicited bulk e-mail tend not to limit their criticism to messages that are commercial in nature.
Unsolicited bulk e-mail is potentially more burdensome than unsolicited fax advertising mainly because of the volume of messages, rather than because of the burden imposed by each individual message.
Bulk e-mail advertisers have urged that an "opt-out" system is appropriate for e-mail advertising, in part because of the relatively low cost involved in receiving an e-mail message, and the relatively high cost of obtaining advance consent from the recipient before an e-mail advertisement is transmitted.

Process Software - PMDF Technical Notes
Mail traffic passing into, through, and out of PMDF can be separated into distinct channels based upon various criteria.
The "attacked" store-and-forward mail system in receipt of one of the messages is then expected (by the spammer) to relay (resend) the message to each of its recipients -- recipients who are generally in many different domains unrelated to that of the attacked mail system.
Thus, the attacked mail system is used as a mail relay and the burden of contacting thousands of individual recipient mail systems is foisted by the spammer onto it.

Mailing list administrators must provide a simple method for subscribers to terminate their subscriptions, and administrators should provide clear and effective instructions for unsubscribing from a mailing list.
Mailing list administrators should make an "out of band" procedure (e.g., a means of contact by which messages may be sent for further correspondence via e-mail or telephone) available for those who wish to terminate their mailing list subscriptions but are unable or unwilling to follow standard automated procedures.
Mailing list administrators must ensure that the impact of their mailings on the networks and hosts of others is minimized by proper list management procedures such as pruning of invalid or undeliverable addresses, or taking steps to ensure that mailings do not overwhelm less robust hosts or networks.

A mail recipient may have at one time asked a sender for bulk email, but then later asked that sender not to send any more email or otherwise not have indicated a desire for such additional mail; hence any bulk email sent after that request was received is also UBE.
Mail sent to an MLA will most likely be re-sent to many people, and those people are the recipients of the original mail, even though that mail has processed and re-sent by the MLA.
Further, many senders of bulk UBE use tactics which are often viewed as devious, and probably illegal, in order to reduce the cost to the sender or even to hide the true identity of the sender.

All of your mailings should be prepared and sent in an ethical and transparent fashion, free from the common earmarks of spam mailing.

Electronic mail (abbreviated "e-mail" or, often, "email") is a store and forward method of composing, sending, storing, and receiving messages over electronic communication systems.
However, this mechanism proved to be exploitable by people sending unsolicited bulk e-mail and as a consequence very few modern MTAs are open mail relays, and many MTAs will not accept messages from open mail relays because such messages are very likely to be spam.

E-mail spam - Wikipedia, the free encyclopedia
The SMTP system, used to send e-mail across the Internet, forwards mail from one server to another; mail servers that ISPs run commonly require some form of authentication that the user is a customer of that ISP.
In an effort to cut down on this abuse, many of these services have adopted a system called the captcha: users attempting to create a new account are presented with a graphic of a word, which uses a strange font, on a difficult to read background.
In the original SMTP mail architecture, this was the default behavior: a user could send mail to practically any mail server, which would pass it along towards the intended recipient's mail server.

Bulk email is any group of messages sent via email, with substantially identical content, to a large number of addresses at once.
Many mailing list administrators are countering this form of abuse by sending a confirmation email to each subscription request, which must be returned in order to be subscribed to the list.
The bulk emailers are an unpopular lot; they forge headers, inject messages into open SMTP ports, use temporary accounts, and pull other stunts to avoid the tirade of complaints that follow every mailing.
