On appeal, Vargas argues that under rule 403, the third prong of the rule 404(b) analysis, the probative value of the evidence outweighed the danger of unfair prejudice, and, therefore, the trial court erred in excluding the testimony of Richards and Allen.
Vargas contends that the statements he made to Heward and Pubela were both so remote in time that they do not qualify as "statements against interest," and, therefore, the statements should be excluded as hearsay under rule 801(c).
Vargas argues that this conclusion was erroneous for two reasons: first, unless there is explicit statutory authority, courts "should exercise judicial restraint by refusing to permit prosecutorial discovery" and second, as applied by the trial court, rule 16(c)'s "good cause" requirement would erroneously require defendants to "automatically.
