Automobile dealership sought variance of setback requirements and clear sight triangle in order to construct a building whose size was specified by the automobile manufacturer.
The variance was ultimately denied because a smaller building suitable for a car dealership, although not meeting the manufacturer's specifications, could be located on the site and still satisfy the dimensional requirements of the zoning ordinance.

The zoning doesn't allow her to operate a business or to use the tract of land for more than one dwelling.
Pedersen requested a zoning variance to allow her to keep four horses on the property, the same as allowed in the subdivision covenants.

Under RCW 64.40.030, an action for damages incident to an application for a land use permit must be commenced within 30 days of the exhaustion of the final administrative remedy.
In reviewing R/L's application Seattle's Department of Construction and Land Use (DCLU) found that its lot was a reverse corner lot and conditioned approval on the structure being limited to two stories rather than three (as proposed) and that any vegetation or fence at the street intersection not exceed 3 feet.
R/L appealed to Seattle's hearing examiner who denied the variance, reasoning that without disclosure of how the lot would be developed (R/L had not submitted a revised development plan) it was not possible to meaningfully apply the City's variance criteria.
