Q4 Vera Baird: You are talking of the fair trial test, which is to be found in 85(3).

Baird chairs the Fawcett Society's commission on women and the criminal justice system, which claims that women are being poorly served by a 'man-made' system.
Baird told BBC One's 'Breakfast': "They're not dangerous people; in addition many children are being separated from their mothers for relatively short periods of time, which is not the usual way to use prison, and in addition to that, rates of recidivism amongst women are going up too, which means prison isn't working."
She concluded by noting that although prison was emotionally traumatic and split up families, it wasn't the "hardest most horrible punishment" in terms of what was asked of a prisoner, compared with tough community sentences.

For completeness I should say that Mrs Baird in her skeleton argument before us objected to the argument based on section 2(3) of the 1964 Act, because she said the farmed part of the applicable land was not "land under the management of the Secretary of State" but land under the management of the farmers.

Mrs Baird, a QC, was referring to an entirely separate clause that would let defendants insist on trial by judge alone.
The changes will not reassure victims, Mrs Baird pointed out: the fl man who claims he has suffered a racial assault and finds that the defendant has chosen to be tried by a white judge, or the rape complainant who finds that no women will be involved in deciding whether her alleged attacker is guilty.
Mr Blunkett was so worried by this risk that he introduced a new clause allowing courts to insist that defendants make up their minds before they knew who the judge would be.
